(A) The Redevelopment Commission has five members, appointed as vacancies occur by the Town Council.
(B) The Walkerton (“Town”) Redevelopment Commission (“Commission”) on 2-28-2005, adopted a declaratory resolution (“Original Declaratory Resolution”) creating the Community Economic Development Area (“Original Area”) and Allocation Area (“Original Allocation Area”) and approved an economic development plan (“Original Plan”) for the Area, which Original Declaratory Resolution and Original Plan were confirmed on 6-15-2005 following a public hearing and distribution of the Impact Statement attached thereto.
(C) The Walkerton Plan Commission (“Plan Commission”) adopted its order dated 5-11-2005 (“Order”) approving the Original Declaratory Resolution and the Original Plan.
(D) The Town Council adopted Res. 2005-1 on 5-16-2005 approving the Original Declaratory Resolution and the Plan Commission Order and adopted its resolution on or about 6-20-2005 approving the creation of the Original Area.
(E) On April 10, 2013, the Commission adopted its Amended and Restated Declaratory Resolution (“Amended and Restated Declaratory Resolution”) for the purpose of amending and restating the Original Declaratory Resolution and the Original Plan to:
(1) Add approximately 31 new acres to the Original Area and the Original Allocation Area (collectively, the “Expansion Area”); and
(2) To incorporate the list of projects set forth in the Amended and Restated Plan, such projects all being in, serving or benefitting the Original Area and the Expansion Area (referred to collectively herein, the “2013 Area”) to the Original Plan (as amended and referred to collectively herein, the “2013 Plan”).
(F) At a public hearing conducted on 4-29-2013, the Commission modified and confirmed its Amended and Restated Declaratory Resolution (“Confirmatory Resolution” and, together with the Amended and Restated Declaratory Resolution, “Amendatory Resolution”).
(G) I.C. 36-7-14-41(c) requires that any enlargement of the boundaries of an economic development area be approved by the Town Council.
(H) The Town Council has reviewed the Amendatory Resolution and previously approved the written order of the Walkerton Plan Commission regarding the Amended and Restated Declaratory Resolution.
(1) The Town Council hereby finds and determines that it will be in the best interests of the Town to expand the boundaries of the Original Area and Original Allocation Area as described in the Amendatory Resolution.
(2) The expansion of the Original Area and Original Allocation Area as described in the Amendatory Resolution is hereby approved.
(3) This resolution shall be effective from and after passage.
