§ 116.32 LICENSE REQUIRED.
   (A)   All itinerant merchants, solicitors and peddlers are required to obtain a license from the office of the Clerk-Treasurer prior to conducting business. The Clerk-Treasurer shall keep a complete record in his or her office of all licenses issued.
      (1)   Application.
         (a)   Any person, firm or corporation desiring to engage in the business of itinerant merchant, peddler or solicitor, as herein defined, shall make an application in writing to the Clerk- Treasurer of the Town at least ten days before said applicant shall be authorized to begin business. Such application shall state the name and residence of the applicant, the company or firm which he or she represents, the place where such business is to be conducted, the kind of goods to be sold and the length of time for which a license is desired.
         (b)   The person, firm or corporation filing said application must pay an application fee as listed in the Fee Schedule in Ch. 35 of this code of ordinances at the time of application. The Clerk- Treasurer shall then refer the application to the Town of Walkerton Police Department for review and recommendation.
         (c)   The Town of Walkerton Police Department shall conduct an investigation of each applicant and make a recommendation to the Clerk-Treasurer as to whether the application should be granted. In making its recommendation, the Town of Walkerton Police Department shall consider the criminal history of the applicant, if any, and the likelihood that granting the application will endanger the health, safety or welfare of the public. A written report of the investigation and a copy of the traffic and police record of the applicant, if any, and the recommendation of the Town of Walkerton Police Department, shall be attached to the application for the consideration of the Clerk-Treasurer.
         (d)   The Clerk-Treasurer shall consider the recommendation of the Town of Walkerton Police Department, and all information provided with or in support of the application in determining whether the application should be granted.
         (e)   The hours of operation of a person engaging in the business of itinerant merchant, peddler or solicitor shall be between the hours of 8:00 a.m. as the beginning time and 6:00 p.m. as the ending time (prevailing Town time), Monday through Friday only.
      (2)   Fee. The license fee per year for an itinerant merchant, peddler or solicitor shall be as listed in the Fee Schedule in Ch. 35 of this code of ordinances and shall be payable in advance for each such license.
      (3)   Term. No license shall be issued for a period of longer than one year.
      (4)   Exhibition. All peddlers, solicitors and itinerant merchants shall be required to exhibit their licenses at the request of any citizen.

   (B)   It shall be unlawful for any itinerant merchant, peddler or solicitor to perform any of his or her defined business within the Town without first having obtained a license as herein provided. The penalty for failing to obtain a license as herein required is set out pursuant to the Appendix: Fines and Penalties in Ch. 31 of this code of ordinances.
