(A) (1) The grantee shall construct, install, operate and maintain its system in a manner consistent with all laws, ordinances, construction standards, governmental requirements, FCC technical standards and detailed standards submitted by the grantee as part of its application, which standards are incorporated by reference herein.
(2) In addition, the grantee shall provide the Town, upon request, with a written report of the results of the grantee’s annual proof of performance tests conducted pursuant to FCC standards and requirements.
(B) Construction, installation and maintenance of the cable communications system shall be performed in an orderly and workmanlike manner. All cables and wires shall be installed where possible, parallel with electric and telephone lines. Multiple cable configurations shall be arranged in parallel and bundled with due respect for engineering considerations.
(C) The grantee shall, at all times, comply with:
(1) National Electrical Safety Code of the Institute of Electrical and Electronic Engineers;
(2) National Electric Code of the National Fire Protection Association;
(3) Applicable FCC or other federal, state and local regulations; and
(4) In any event the system shall not endanger or interfere with the safety of persons or property in the franchise area or other areas where the grantee may have equipment located.
(D) The Town shall retain the right to supervise all construction and installation work performed subject to the provisions of this chapter and to make such inspections as it may find necessary to ensure compliance with governing ordinances.
