§ 112.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. The word “shall” is always mandatory and not merely directory.
   CABLE CASTING. Programming carried on a cable system, exclusive of broadcast signals, whether originated by the cable operator or any other party.
   CABLE TELEVISION SYSTEM or CATV SYSTEM. A system of antennas, cables, wires, lines, towers, wave guides or other conductors, converters, equipment or facilities designated and constructed for the purpose of producing, receiving, transmitting, amplifying and distributing audio, video and other forms of electronic or electrical signals located in the Town. Said definition shall not include any such facility that serves or will serve only subscribers in one or more multiple unit dwellings under common ownership, control or management and does not use Town rights-of-way.
   FCC. The Federal Communications Commission.
   GRANTEE. The party or parties to which a franchise under this chapter is granted by the Town Council and its or their lawful successors and assigns.
   GROSS REVENUES. Any and all compensation in whatever forms, exchange or otherwise derived from the provision of all cable services in the Town.
   PERSON. Any person, firm, partnership, association, corporation, company or organization of any kind.
   SUBSCRIBER. Any person, firm, corporation or other entity receiving or wired to receive for any purpose the service of the grantee herein.
   TOWN. The Town of Walkerton, St. Joseph County, Indiana, in its present incorporated form or as it may be changed by annexation.
   TOWN COUNCIL. The Town Council of the Town of Walkerton, St. Joseph County, Indiana.
   TWO-WAY COMMUNICATIONS. The transmission of telecommunications signals from subscriber locations or other points throughout the system back to the systems control center as well as transmission of signals from the control center to subscriber locations.
   USER. A party utilizing a cable television system channel for purposes of production or transmission of material to subscribers as contrasted with receipt in a subscriber capacity.
