§ 74.06 ACCIDENT REPORTS.
   (A)   (1)   The driver of a vehicle involved in an accident resulting in property damage or injury to or death of any person shall immediately by the quickest means of communication give notice of such accident to the Police Department if such accident occurs within the Town.
      (2)   The driver of a vehicle which is in any manner involved in an accident resulting in property damage or injury to or the death of any person shall, within five days after such accident forward a written report of such accident to the Police Department, or a copy of any report he or she is required to forward to the state. The provisions of this division (A)(2) shall not be applicable when the accident has been investigated at the scene by a police officer while such driver was present.
      (3)   Whenever the driver of a vehicle is physically incapable of giving immediate notice of an accident as required in this section and there was another occupant in the vehicle at the time of the accident capable of doing so, such occupant shall give, or cause to be given, the notice not given by the driver.
      (4)   Whenever the driver is physically incapable of making a written report of an accident as required herein and such driver is not the owner of the vehicle, then the owner of the vehicle involved in such accident shall within five days after learning of the accident make such report not made by the driver.

   (B)   All written accident reports made by drivers, owners or occupants of vehicles involved in accidents as required herein shall be without prejudice to the individual so reporting and shall be for the confidential use of the Police Department or other governmental agencies having use for the records for accident prevention purposes; except that, the Police Department may disclose the identity of a person involved in an accident when such identity is not otherwise known or when such person denies his or her presence at such accident. No such report shall be used as evidence in any trial, civil or criminal, arising out of any accident; except that, the Department shall furnish upon demand of any person who has, or claims to have, made such a report or upon demand of any court, a certificate showing that a specified accident report has or has not been made to the Police Department solely to prove a compliance or a failure to comply with the requirements that such a report to be made to the Department.
