§ 30.003 TOWN COUNCIL.
   The powers of the Town Council include:
   (A)   Elect a President;
   (B)   Make and establish such by-laws, ordinances and regulations as may be necessary and not repugnant to the laws of the state and to repeal, alter or amend same as deemed necessary;
   (C)   Shall, by ordinance, provide reasonable compensation for Council members, Town Court Judge, Town Clerk-Treasurer, appointive personnel and employees of the Town and to have the right to change the compensation at any time it deems proper. Such change to be affected by a majority vote and amended ordinance, pursuant to I.C. 36-5-3-2 and I.C. 36-5-3-2(b), the compensation of an elected Town official may not be changed in the year for which it is fixed, nor may it be reduced below the amount fixed for the previous year;
   (D)   Codify and publish Town ordinances;
   (E)   Make the following appointments annually:
      (1)   Town Attorney;
      (2)   Code Enforcement Officer;
      (3)   Economic Development Director;
      (4)   Chief of Police (upon recommendation of Walkerton Metropolitan Board of Police Commissioners);
      (5)   Building Commissioner; and
      (6)   Public Works Director.
   (F)   Appoint the following vacancies as they occur:
      (1)   Walkerton Historical Society;
      (2)   Plan Commission;
      (3)   Board of Zoning Appeals;
      (4)   Library Board; and
      (5)   Walkerton Economic Development Corporation.
   (G)   The President of the Town Council shall appoint two members of the Council to serve on the Fire Territory Board;
   (H)   Levy taxes within statutory limitations, subject to review by the County Board of Tax Adjustment and the Department of Local Governmental Finance;
   (I)   Purchase and hold real estate necessary for carrying out Town functions;
   (J)   Build and repair municipal structures;
   (K)   Insure public property of the Town;
   (L)   Purchase and maintain cemeteries;
   (M)   Plant trees and acquire land for park purposes;
   (N)   Provide recreation facilities for the Town, and establish a Park Board to conduct playground and recreational centers;
   (O)   Create a Plan Commission to promote orderly development of its governmental units and environs;
   (P)   Provide for lighting of streets and public places;
   (Q)   Contract with owners of real estate for the construction of storm, sanitary or combination sewers within the Town, or within four miles of the corporate limits;
   (R)   May establish Town drainage district upon petition;
   (S)   Determine what constitutes a public nuisance and provide for its abatement;
   (T)   Regulate salesmen, merchants, itinerant vendors and street auctions;
   (U)   Carry out other necessary functions of the Town corporation; and
   (V)   All other powers not prohibited by law.
