§ 70.99 PENALTY.
   (A)   Penalty schedule.
      (1)   Penalties will be assessed for the following violations:
         (a)   For improper parking;
         (b)   For non-moving traffic; and
         (c)   For moving traffic violations:
            1.   Stop sign violations;
            2.   Improper parking;
            3.   Speeding not in excess of 15 miles over the speed limit;
            4.   Speeding in excess of 15 mph over the limit, but not more than 25 miles over the limit;
            5.   Speeding in excess of 25 miles over the speed limit;
            6.   Yield sign violations; and
            7.   All other moving violations.
      (2)   Each violation above constitutes an infraction. A penalty will be assessed pursuant to the Appendix: Fines and Penalties in Ch. 31 of this code of ordinances, upon conviction by the Town Court Judge as per provisions set herein. Those persons receiving citations should contact the court before their appearance date to determine their fines and costs.

   (B)   Notice of violation.
      (1)   Whenever the Walkerton Chief of Police or the Town of Walkerton police officers find the owner or operator of any vehicle or other person has committed any action which is declared unlawful by the provisions of state traffic statutes or Town ordinances, such officers shall give uniform traffic citation to such person of such violations. All uniform traffic citation shall be serially numbered and shall contain the following:
         (a)   The specific violation with which the violator is charged;
         (b)   The license plate number and type of vehicle;
         (c)   The name and address of the owner of the vehicle and the operator of the vehicle, if possible to obtain same;
         (d)   The location of the violation;
         (e)   The name of the officer;
         (f)   The date of the violation; and
         (g)   The date the violator is to be in the Town Court.
      (2)   The notice shall also contain the following statement:
            “From the time of the violation to the court date as shown on the Uniform Traffic Citation of the Violation, the violator may bring the Uniform Traffic Violation to the Walkerton Town Court, Walkerton Municipal Building, 301 Michigan, Walkerton, Indiana 46574, or mail the fine to such address within the said time. The Town Court shall send a judgment letter notifying the violator of nonpayment, of the possible suspension of their driving privileges by the Department of Motor Vehicles and filing of additional charges pursuant to I.C. 34-28-5-1 et seq.”

   (C)   Payment of fines.
      (1)   Any person receiving a uniform traffic citation for a traffic violation pursuant to the provisions of this traffic code shall, prior to the court date on the citation, appear at the Town Court, 301 Michigan, Walkerton, Indiana 46574 and pay the imposed penalty by depositing such amount along with the uniform traffic citation. The Town Court shall send a judgment letter to those who do not comply with the above. This judgment letter will indicate payment and notification of the possible suspension of driving privileges by the Department of Motor Vehicles and filing of additional charges pursuant to I.C. 34-28-5-1 et seq.
      (2)   In addition to the penalties provided for herein, the Walkerton Chief of Police or police officers may cause any vehicle parked in violation of any provision of state traffic statutes or Town ordinances to be removed to a private garage or place where the same shall be impounded and retained. Such vehicle shall be released only upon order of the Walkerton Chief of Police or Deputy Chief of Police after payment of the fine required by this traffic code to be paid in compromise of such violation and all costs of towing and storage.
