(A) This subchapter sets forth uniform requirements for users of the publicly owned treatment works (POTW) and enables the Town to comply with all applicable state and federal laws required by the Clean Water Act of 1977, being 33 U.S.C. §§ 1251 et seq. and the General Pretreatment Regulations of 40 C.F.R. part 403).
(B) The objectives of this subchapter are:
(1) To prevent the introduction of pollutants into the municipality wastewater system which will interfere with the normal operation of the system or contaminate the resulting sludge;
(2) To prevent introduction of pollutants into the POTW which do not receive adequate treatment in the POTW, and which will pass through the system into receiving waters or the atmosphere or otherwise be incompatible with the system; and
(3) To improve the opportunity to recycle and reclaim wastewaters and sludge from the system.
(C) (1) This subchapter provides for the regulation of direct and indirect dischargers to the municipal wastewater system through the issuance of permits to certain non-domestic users and through enforcement of general requirements for the other users, authorizes monitoring and enforcement activities, requires user reporting, assumes that existing customer’s capacity will not be pre-empted and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein.
(2) This subchapter does not provide for the recovery of operations, maintenance or replacement costs of the POTW or the costs associated with the construction of collection and treatment systems used by industrial dischargers, in proportion to their use of the POTW, which are the subject of a separate ordinance.
(3) This subchapter shall apply to the Town and to persons outside the Town who are, by contract or agreement with the Town, users of the Town POTW.
(4) This subchapter is a supplement to Ord. 4-78 as amended.
(5) Except as otherwise provided herein, the Public Works Director of the Town’s wastewater utilities (POTW) shall administer, implement and enforce the provisions of this subchapter.
