941.08 COLLECTION AND DISPOSAL CONTRACT PROVISIONS.
   (a)   Until otherwise provided by ordinance, the Municipality shall enter into a contract with a person, firm, or corporation for the furnishing of such light-covered truck or trucks and the furnishing of such employee or employees as are necessary and required, and the furnishing of proper facilities for the lawful collection and disposal of refuse and rubbish and the furnishing of all services necessary and required for the proper collection and disposal of the refuse and rubbish from all residents, owners, or householders within the Municipality, as hereinbefore set forth.
 
   (b)   The contract shall be for one year or other length of time as Council shall, from time to time, determine. The contract shall be entered into with the lowest and best bidder after advertisement for bids, as required by law. Within ninety days of the expiration of an existing contract, the Clerk-Treasurer is authorized to advertise for bids on a new contract. The contract price being paid in monthly payments beginning thirty days after the effective date of the contract.
 
   (c)   All bids shall be accompanied by a certified check in the sum of five percent (5%) of the bid price or a certified check for one hundred dollars ($100.00) or which ever is the greater amount, as a guarantee that the successful bidder will enter into a contract binding such contractor to, among other things, collect and lawfully dispose of all refuse and rubbish, properly contained, wrapped, packaged, bundled, and located from each and every resident, owner, or householder within the Municipality, as hereinbefore set forth.
   The contractor shall also provide trucks which will not leak liquids or permit blowing off and scattering of papers, boxes, etc.; furnish evidence of liability and property damage insurance, liability limits fifty thousand dollars ($50,000) to one hundred thousand dollars ($100,000) coverage, property damage limit ten thousand dollars ($10,000) coverage, on all motor vehicles used in furnishing such service and complying with the terms and conditions of the contract; furnish evidence of coverage under all unemployment and workers' compensation laws and other similar statutes conditioned upon the full and complete performance of the terms of the contract, and such other terms and conditions as are required by Council.
