373.13 SKATEBOARDS AND ROLLER SKATES.
   (a)   “Skateboard” means any platform device designed and intended to move or propel one or more riders over a hard surface by means of roller wheels utilizing gravity or human impetus.
   (b)   “Roller skate” means any device fitted upon the human foot designed and intended to propel persons over hard surfaces by means of roller wheels utilizing gravity or human impetus.
   (c)   Every person riding a skateboard or wearing roller skate devices on public or private sidewalks shall not do so upon public street surfaces designed primarily for motor vehicles and shall dismount when crossing intersections.
   (d)   Every person riding a skateboard or wearing roller skate devices shall do so on private property only with the permission of the person(s) in control thereof and shall so ride upon public street rights of way only on sidewalks, except in the area herein restricted.
   (e)   No person shall ride a skateboard or wear roller skate devices upon public or private property with the following heavily congested pedestrian oriented central downtown business area, defined as follows:
      (1)   Main Street between Cooper Street and Verlin Street;
      (2)   Cooper Street between Main Street and Abbott Street;
      (3)   Abbott Street between Cooper Street and Verlin Street;
      (4)   Verlin Street between Abbott Street and Main Street; and
      (5)   Pleasant Street between Main Street and Abbott Street.
   (f)   Every person riding a skateboard or wearing roller skate devices shall operate on any sidewalk, public or private, in single file as near to the right side of the sidewalk as is practical and shall exercise due care when passing or meeting other persons or property upon such sidewalk area.
   (g)   Every person riding a skateboard or wearing roller skate devices shall yield the right of way to all pedestrians at all times and shall pass them, without causing injury or reasonable fear for their safety, even if dismounting or the cessation of locomotion shall be necessary.
   (h)   Every person riding a skateboard or wearing roller skate devices shall dismount a skateboard at a street intersection and shall walk as a pedestrian across such intersection.
   (i)   Every person riding a skateboard or wearing roller skate devices shall, before overtaking, meeting in the opposite direction, or passing a blind person carrying a white can or guided by a dog, dismount and/or overtake, meet or pass on foot.
   (j)   No person shall ride a skateboard or wear roller skate devices at night upon public or private sidewalks unless such person wears distinctive, reflective clothing or specific reflective devices upon his or her person in such size and magnitude as to give reasonably prudent persons notice of the skateboard’s or roller skater’s presence and proximity in the immediate area.
   (k)   Whoever violates this section shall be guilty of a minor misdemeanor. Whoever violates this section after having plead guilty or having been convicted of one violation of this section within the preceding twelve months shall be guilty of a misdemeanor of the fourth degree. Whoever violates this section after having plead guilty or having been convicted of two violations of this section within the preceding twelve months shall be guilty of a misdemeanor of the third degree. Whoever violates this section after having plead guilty or having been convicted of three or more violations of this section within the preceding twelve months shall be guilty of a misdemeanor of the second degree.
