(a) No person shall drive or operate or cause to be drive or operated, any commercial car, trailer or semi-trailer which is equipped with engine brakes, or special brakes in such a manner that the use of said brakes creates a public nuisance to the citizens of the Village of Wakeman, Ohio. (b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
