725.05 LICENSE FEE; TRANSFER; DISPLAY.
   (a)   The license fee, payable to the Village at the time of application, shall be $500.00 for each business location for the first year or any part thereof ending on December 31st of the first year of operation; $1,000.00 for each business location for the second year or any part thereof ending on December 31st of the second year of operation; and $1,500.00 for each business location for the third year or any part thereof ending on December 31st of the third year of operation and for every year thereafter. In addition, a $25.00 fee for each entertainment device on the premises shall be paid each quarter or any part thereof ending on the last day of each quarter, after the first year of operation. The license fee, which is paid at the time of application, is not refundable in any case. The per machine fee shall be paid for each entertainment device brought to the facility before the device is put into use after the first year of operation or any part thereof. For purposes of determining licensing fees, each device that is operable by one or more persons is a separate device.
   In the event the internet sweepstakes cafe business is sold or otherwise transferred to a new owner, the previous owner must show that the prior business was not profitable in order for the new owner to begin paying the first year licensing fee.
   (b)   Licenses issued under this chapter shall not be transferable to any other person, partnership, corporation, or other entity and the business may be conducted only at the location for which the license is issued. The license must be so placed as to be made conspicuously visible and shall list each entertainment device with serial number.
   (c)   Failure to register any entertainment device before putting it into service on the premises is an unclassified misdemeanor and the operators shall each be liable for a mandatory fine of $100.00 for each day the machine is not registered, and said fine shall not be reduced or suspended.
