1313.01 PUBLIC NUISANCE PROHIBITED; NOTICE TO ABATE.
   (a)   No person shall suffer or permit to exist within the Village any act, thing or condition of a kind which has been or may hereafter be defined by ordinance or Ohio law as a public nuisance.
   (b)   Whenever a public nuisance exists, the appropriate Village Department shall cause the owner, tenant, or person in charge of the property upon which such public nuisance exists to be served with a notice to abate such public nuisance on or before fifteen (15) days after receipt of such notice. Notice as described herein shall consist of mailing the same to the owner, tenant, or person in charge of such property by registered or certified mail, return receipt requested, by personal service, or by posting such notice in a conspicuous place upon such property for a period of five (5) days.
   (c)   No person shall fail to comply with any notice as required herein.
   (d)   (1)   Whoever fails to comply with such notice shall be deemed guilty of a misdemeanor of the fourth degree, and each day of such noncompliance or violation shall constitute a separate offense.
      (2)   Whoever fails to comply with such notice and within one year of the offense, previously has been convicted of or pleaded guilty to one violation of this section, shall be deemed guilty of a misdemeanor of the third degree, and each day of such noncompliance shall constitute a separate offense.
      (3)   Whoever fails to comply with such notice and within one year of the offense, previously has been convicted of or pleaded guilty to two violations of this section shall be deemed guilty of a misdemeanor of the second degree, and each day of such noncompliance shall constitute a separate offense.
      (4)   Whoever fails to comply with such notice and within one year of the offense, previously has been convicted of or pleaded guilty to two or more violations of this section, shall be deemed guilty of a misdemeanor of the first degree, and each day of such noncompliance shall constitute a separate offense.
