339.12 WEIGHT REDUCTION FOR THAWS OR MOISTURE.
   (a)    When thaws or excessive moisture render the Village streets and highways or any parts thereof insufficient to bear the traffic thereon, or when such streets or highways would be damaged or destroyed by heavy traffic during the period of thawing or excessive moisture, the maximum weight of vehicle and load, or the maximum speed, or both, for motor vehicles as prescribed by Village ordinances may be reduced by the Mayor on streets and highways other than State routes, as the condition of such streets or highways justifies, but in no case shall such reduction be more than fifty percent (50%).
   (b)    The schedule of the reduction shall be filed showing the maximum weight and speed, for the information of the public, in the office of the Police Chief. The Mayor at least one day before the reduction becomes effective, shall cause to be placed and retained on such streets or highways, at both ends and at the points of intersection of principal streets during the period of such reduced limitation of weight, speed or both, signs of substantial construction which conspicuously indicate the limitations of weight and speed which are allowed on the streets or highways, and the date on which such limitations shall be effective.
   (c)   No person shall operate upon any street or highway a motor vehicle the maximum weight or speed of which is in excess of the limitation which may be prescribed pursuant to this section.
   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
