(A) The city, in order to more effectively promote and protect the public health and welfare, hereby reserves unto itself the exclusive right to collect all solid waste, or any portion thereof, in the city at such times and for such periods as in its judgment is in the best interest of the city, provided, however, the city may grant to one or more companies the non-exclusive right and privilege to collect, for hire, solid waste, or any portion thereof, within the city, pursuant to terms and conditions as set forth in this chapter.
(B) It shall be unlawful for any person to collect and/or dispose of their solid waste, or any portion thereof, except said prohibition shall not apply to the following:
(1) The city; or
(2) The holder of a right and privilege hereunder; or
(3) Any person who lawfully collects and hauls their own solid waste, or any portion thereof, or yard waste of their own, or of other persons within the corporate limits of the city, to:
(a) A solid waste facility with which the city has a written contract; or
(b) An entity that recycles or reuses any portion of the person's solid waste; or
(c) A limited landfill maintained by the city; or
(d) Meets the criteria established by Mayor and Council of the city pursuant to Neb. RS 13-2020(4).
(C) All solid waste collected within the city shall be disposed of in a solid waste facility with which the city maintains or with which the city has a written contract or with which company and/or companies has a written contract.
