§ 37.04  EMERGENCY SUCCESSION ACT.
   (A)   The Mayor and Council has invoked the provisions of the Emergency Succession Act as passed by the state of Nebraska. All the provisions of the said act are invoked in this code as though fully set out herein as it now exists or may hereafter be amended to provide. In compliance with the said act, the following officers of the city shall appoint emergency interim successors to the powers and duties of their respective offices:
      (1)   Each member of the City Council.
      (2)   The Sewage Plant Operator.
      (3)   The Chief of Police.
      (4)   The Chief of the Fire Department.
      (5)   The City Attorney.
      (6)   The City Clerk.
      (7)   The City Treasurer.
      (8)   The City Engineer.
      (9)   The Utilities General Manager.
      (10)   The Streets Superintendent.
   (B)   The provisions of division (A) of this section are not exclusive, however, and shall not be construed in such a manner as to prohibit the appointment of alternates by any other duly, elected or appointed officers of this city, including but not limited to the head of any department or section, or the members of any board or other agency of the city government; or as to excuse the failure on the part of any such officer to make such appointments, when clearly required by the act.
