§ 113.13 CONDITIONS.
   No beer garden shall be permitted, maintained, or operated except in conformity with the following regulations:
   (A)   The beer garden area shall be particularly described and included within the application for Class I Liquor License licensed premises.
   (B)   The beer garden area shall not exceed 75% of the gross floor area of the adjoining licensed structure.
   (C)   Construction of the beer garden shall be as follows:
      (1)   The ground area shall be of a fire-resistant material.
      (2)   There shall be maintained a fence surrounding the beer garden area as determined by the City Council.
   (D)   All electrical wiring shall comply with national, state, and city electrical codes.
   (E)   All combustible rubbish shall be stored in non-combustible covered containers.
   (F)   No amplified sound or music is permitted outside the enclosed building premises. Any noise emanating from the beer garden shall not violate the regulations concerning noise.
   (G)   The area shall be adequately illuminated by electric lights, but such illumination shall be so arranged and shielded by the licensee so as to reflect away from adjoining property and streets.
   (H)   Occupancy capacity shall be clearly posted.
