(A) Application for a license required under the provisions of this subchapter shall be made in the office of the City Clerk only between January 1 and April 1 of each year on an application form prescribed and furnished by the City Clerk. The application form shall require of the applicant the following information:
(1) Name, address, and telephone number of applicant, and if applicant is a corporation, or a similar type organization, then in addition to the aforenoted information, the name, address, and telephone number of a contact person who shall be responsible for the fireworks license;
(2) A plot plan showing the location of the stand, address, legal description, setback from street right-of-way, distance to nearest building or structure, and occupancy of nearest structure or structures, said plot plan also to include the area 100 feet on either side of said area to be utilized and the nature of the structures within said area;
(3) The zoning district in which the area to be utilized by the applicant for the sale of permissible fireworks at retail is located;
(4) A list of persons, over the age of l9 years, who will be employed by the applicant and who, at any given time, will be in charge of the place of sale of permissible fireworks;
(5) Such other information as may be required for the enforcement of this subchapter.
(6) Agree to be bound by all ordinances of the city and to comply with all laws, regulations and rules of the State of Nebraska;
(7) To be signed and acknowledged by the applicant.
(B) If the application is for a license for the sale of permissible fireworks at retail at a location within the NRC Neighborhood Residential Commercial, C-1 Central Business and C-2 Highway Commercial Districts of the city, the City Clerk shall issue a written permit or denial thereof, with reasons in writing, if denied, within 15 days from the date of the filing of the application.
(C) If the application for a license for the sale of permissible fireworks at retail is located within any other zoning district of the city for which a Permitted Special Use is required, the City Clerk shall submit said application to the Mayor and City Council at their next regular or special meeting for discussion and action. Only the provisions of Article 6, Sections 6.1 and 6.2 of the zoning ordinance shall be applicable and all other provisions of Article 6 shall not be applicable to the permitted special use application for the sale of permissible fireworks at retail. The Mayor and City Council shall issue a written permit or denial thereof, with reasons in writing, if denied, within 15 days from the date of the meeting of the Mayor and City Council regarding said application.
(D) Applicant shall pay to the City Clerk a nonrefundable application processing fee as follows:
(1) $50 if the site of the fireworks location is in either the NRC, C-1 or C-2 Zoning Districts;
(2) $100 if the site for the fireworks location is other than in the NRC, C-1 or C-2 Zoning Districts.
