3-1-4: CLASSIFICATION; SCHEDULE OF FEES; NUMBER OF LICENSES:
There shall be the following classes of licenses with the following license fees:
   A.   Class A Licenses: The initial fee for the first license year, or any part thereof, shall be two thousand five hundred dollars ($2,500.00) and shall permit the holder to sell, deal or traffic in intoxicating liquors to be consumed only on the premises so licensed, and in the original package for consumption off the premises. Any display area of alcoholic liquor for retail sale in the original package shall not exceed eighteen (18) square feet in the premises so licensed, and no advertising of retail sales of package goods shall be carried on, other than the price of the package being attached to the display area. The renewal fee for such license shall be one thousand dollars ($1,000.00) annually.
   B.   Class B Licenses: Holders of class A or E licenses may apply for a class B license to operate, outside the structure designated for such sale, upon those premises a beer garden, or area for use of umbrella, or cabana type structures for serving alcoholic liquors at retail. Such license may be issued pursuant to written application, after hearing before the LLCC, and payment of an additional fee of three hundred dollars ($300.00) annually.
   C.   Class C Licenses: The initial fee for the first license year, or any part thereof, shall be two thousand five hundred dollars ($2,500.00) and shall permit the holder to sell at retail, but not for consumption on the premises where sold, alcoholic liquor in the original package, and without any limitation of display area or advertising by a person so engaged in the retail sale of alcoholic liquor. The renewal fee for such license shall be one thousand five hundred dollars ($1,500.00) annually.
   D.   Class D Licenses: A twenty four (24) hour permit to sell, deal and traffic in intoxicating liquor only on the premises so licensed. A twenty dollar ($20.00) fee will be charged by the building and zoning department for a temporary use permit. The license fee shall be fifty dollars ($50.00) for a period of twenty four (24) hours; provided, that the permit may be extended to ninety six (96) hours, consecutively, at a fee of five dollars ($5.00) for each additional twenty four (24) hour period or fraction thereof. Class D permits will be issued only to specific organizations, and in no case to private individuals. Not more than four (4) class D licenses shall be issued to the same location in any calendar year. The LLCC shall have the authority to waive the fee under this section for charitable organizations.
   E.   Class E Licenses: The initial fee for the first year, or any part thereof, shall be two thousand dollars ($2,000.00) and shall permit the holder to sell, deal or traffic in beer and wine to be consumed only on the premises so licensed, and in the original package for consumption off the premises. Any display area of beer and wine for retail sale in the original package shall not exceed eighteen (18) square feet in the premises so licensed, and no advertising of retailed sales of package goods shall be carried on, other than the price of the package being attached to the display area. The renewal fee for such license shall be eight hundred fifty dollars ($850.00) annually.
   F.   Class F Licenses: The initial fee for the first license year, or any part thereof shall be two thousand dollars ($2,000.00) and shall permit the holder to sell at retail, but not for consumption on the premises where sold, beer and wine in the original package, and without any limitation of the display area or advertising by a person so engaged in the retail sale of beer and wine. The renewal fee for such license shall be one thousand dollars ($1,000.00) annually.
   G.   Class G Licenses: A class G license shall authorize the retail sale of alcoholic liquors for consumption on the premises and shall be issued only to fraternal, charitable or religious organizations. The annual fee for a Class G license shall be fifty dollars ($50.00).
   H.   Class H Licenses: The initial fee for the first license year, or any part thereof, shall be two thousand five hundred dollars ($2,500.00) and shall permit the holder of a Class H license to sell at retail alcoholic liquor in the original package for consumption off premises and beer and wine for consumption on the premises where sold. The renewal fee for such license shall be one thousand five hundred dollars ($1,500.00) annually.
   I.   Class I Licenses: The initial fee for the first license year, or any part thereof, shall be two thousand five hundred dollars ($2,500.00) and shall permit the holder to sell, deal or traffic in intoxicating liquors to be consumed only on the premises so licensed, and in the original package for consumption off the premises. The licensed premises shall be a banquet facility; consumption of alcoholic beverages shall only be permitted when it is accessory to food service. Any display area of alcoholic liquor for retail sale in the original package shall not exceed eighteen (18) square feet in the premises so licensed, and no advertising of retail sales of package goods shall be carried on, other than the price of the package being attached to the display area. The renewal fee for such license shall be one thousand dollars ($1,000.00) annually.
   J.   Class J License: A Class J license shall entitle the licensee to sell alcoholic liquor at retail for consumption on the premises of a village-sponsored event, subject to the following conditions:
      1.   For the purposes of this license classification, "village-sponsored event" means an event which the village supports or promotes and is designated as a village-sponsored event by the village board.
      2.   A Class J license may only be issued to the holder of a valid Class A, Class E, Class G, Class H, or Class I license issued by the village.
      3.   The sale and consumption of alcoholic beverages may only occur within the designated areas of the village-sponsored event.
      4.   The sale of alcoholic beverages may only occur during the hours designated by the liquor commissioner for the specific village-sponsored event.
      5.   A Class J license shall be required for each specific village- sponsored event, and shall only be valid for the length of the specific village- sponsored event as determined by the liquor commissioner.
      6.   A Class J licensee must provide the liquor commissioner with evidence of sufficient dram shop liability insurance.
      7.   A Class J licensee shall hold harmless the village, its elected and appointed officials, officers, employees, agents and representatives from any and all claims or causes of action arising out of the sale of alcoholic liquor by the licensee at the village-sponsored event.
      8.   The liquor commissioner shall have authority to supply limitations, conditions, or additional requirements upon the issuance of a Class J license as appropriate for the specific village-sponsored event.
      9.   The annual fee for Class J license shall be fifty dollars ($50.00). This fee may be waived at the LLCC's discretion.
   K.   Number Of Licenses: The following shall be the number of licensees to be issued: there shall be issued no more than five (5) Class A licenses; two (2) Class B licenses; three (3) Class C licenses; zero Class D licenses; three (3) Class E licenses; two (2) Class F licenses; one (1) Class G license; five (5) Class H licenses; one (1) Class I license; and one (1) Class J license. Upon revocation, forfeiture, nonrenewal, voluntary surrender or termination (pursuant to subsection 3-1-3I, and section 3-1-11 of this chapter) of an existing license of any class A, B, C, D, E, F, G, H, or I license, the number of licenses available for such class shall automatically be reduced accordingly and then this subsection shall be deemed to be amended in conformance with such reduction.
