3-1-1: LOCAL LIQUOR CONTROL COMMISSIONER:
   A.   Commissioner Defined: The village president shall be the local liquor control commissioner ("LLCC").
   B.   Duties: The LLCC shall have all the powers and duties prescribed by law, including, but not limited to:
      1.   Grant, Suspend Or Revoke License: To grant, or suspend for not more than thirty (30) days, or to revoke for cause, any local license subject to his jurisdiction.
      2.   Inspection: To enter, or to authorize any inspector, law enforcement officer, or peace officer, to enter at any time upon any premises licensed hereunder for the purpose of determining whether any of the provisions of this chapter have been or are being violated, and to inspect or examine such premises at the time of entry thereon.
      3.   Sanitary Conditions: To require that all licensed premises be maintained and operated in a sanitary condition, and in compliance with all applicable rules and regulations of the Lake County health department, and in compliance with all ordinances of the village.
      4.   Certificate Of Approval: To require that any licensee secure and file with the LLCC a current certificate demonstrating licensure and compliance with all applicable rules and regulations of the Lake County health department.
      5.   License Fees: To receive all local license fees and to pay the same forthwith to the village treasurer.
      6.   Examinations: To examine, or cause to be examined, under oath, any applicant for a license, or for a renewal thereof, or any licensee upon whom a notice or revocation or suspension has been served, and to examine or cause to be examined, the books and records of any such applicant or licensee. The LLCC, in conducting such examination, may hear testimony and receive proof, and in connection with such examination, may issue subpoenas which shall be effective in any part of the state. In conducting such examinations, the LLCC may authorize his agent to act on his behalf.
      7.   Transfer To Different Premises: After a license has been granted for a particular premises, the LLCC, upon proper showing, may permit the licensee to abandon the premises therein described and to relocate his place of business to other premises approved by the LLCC. However, in order to obtain such approval, the licensee shall file with the LLCC a written request and a one hundred dollar ($100.00) hearing fee. The LLCC shall confirm that the proposed new premises shall comply in all respects with the provisions of all applicable ordinances of the village. Upon receipt of such request, the LLCC will conduct a hearing to inquire into, and receive evidence bearing upon the relocation to other premises. (Ord. 95-433, 12-5-1995, eff. 4-30-1996)
