12-4-5: TREE REMOVAL PERMIT REQUIRED:
No person shall commence tree removal, or damage any live protected tree without first having obtained a tree removal permit from the Village. There shall be no charge for the permit. Applications for permits may be obtained from the Village Forester. Prior to the issuance of a permit for tree removal, the Village Forester shall conduct an on-site inspection to determine whether or not the removal conforms to the criteria of this Title. The permit shall be issued if any one of the following conditions is present:
   A.   It is reasonably necessary to remove trees which pose a safety hazard to pedestrian or vehicular traffic, or threatens to cause disruption of public service.
   B.   It is reasonably necessary to remove trees which pose a safety hazard to buildings.
   C.   It is reasonably necessary to remove diseased trees, or trees that have been weakened by age, storm, fire, or other injury.
   D.   It is reasonably necessary, consistent with sound and recognized forestry practices, for the tree to be removed.
   E.   It is reasonably necessary to remove the trees in order to construct proposed improvements, which are consistent with the zoning of the property upon which the tree is located, and there is no reasonable alternative available on the site.
   F.   In order to comply with any other applicable Village ordinance provisions, it is necessary for the trees to be cut or relocated. (Ord. 97-473, 4-1-1997)
