11-4-5: FINAL PLAT:
After the approval of the preliminary plat, the subdivider shall submit to the Village all required final engineering plans, drawings, calculations, and details for all required improvements, including a field tile survey, including dimension, if reasonably practical. The Plan Commission shall not take final action upon the final plat until the engineering drawings have been reviewed and approved by the Village Engineer.
   A.   Procedure:
      1.   Filing Of The Final Plat:
         a.   After the Village Engineer has reviewed and approved the final engineering plans, the subdivider shall submit to the Village Board of Trustees, twenty (20) copies of the final plat. The Village Board of Trustees shall refer the final plat to the Plan Commission for its review and recommendation. No person shall subdivide any parcel of land until a final plat shall have been reviewed and approved by the Village Board of Trustees, as set forth herein, and duly recorded.
         b.   The final plat shall conform substantially to the approved preliminary plat.
      2.   Action By The Plan Commission:
         a.   The Plan Commission shall determine if the final plat is in substantial conformance with the approved preliminary plat and that the Village Engineer has reviewed and approved the final plat and final engineering plans.
         b.   If the Plan Commission determines that it is in substantial conformance, the chairman shall affix his signature to the final plat.
         c.   If the Commission determines that the final plat is not in substantial conformance with the approved preliminary plat, the Commission shall set forth its findings in its own records and shall forward a copy to the subdivider and to the Village Board.
      3.   Action By The Planning, Zoning, And Plats Committee: The Planning, Zoning and Plats Committee shall determine if the final plat is in substantial compliance with the approved preliminary plat and shall forward its findings to the Village Board and the subdivider.
      4.   Action By The Village Board: After the review of the final plat by the Plan Commission and the Planning, Zoning and Plats Committee, the Village Board of Trustees shall approve or deny the final plat. When a subdivider submitting a plat of subdivision or resubdivision for final approval has supplied all drawings, maps and other documents, including acceptable letter of credit or other surety to guarantee the construction of the public improvements, required by the Village ordinances to be furnished in support thereof, and if all such material meets all Village requirements, the Village Board shall approve the proposed plat within sixty (60) days from the date of filing the last required document or other paper or within sixty (60) days from the date of filing application for final approval of the plat, whichever date is later. The subdivider and the Village Board may mutually agree to extend the sixty (60) day period. If the Board of Trustees approves the final plat, it shall authorize the Village President and Village Clerk to affix their signatures to the plat. If the Board of Trustees disapproves the final plat, it shall set forth its reasons in its records and shall forward a copy to the subdivider.
      5.   Recording Of The Plat: Upon approval by the Village Board of Trustees, the subdivider shall collect the other necessary signatures, and the Village Clerk shall record the plat with the County Recorder of Deeds at the subdivider's expense. For the recording of the final plat, the Village Clerk shall receive from the subdivider the signed mylar and six (6) blueprints of the approved final plat and three (3) copies of the approved supporting documents. The cost of such prints and copies of documents shall be paid by the subdivider.
      6.   Distribution Of Copies Of The Recorded Final Plat: The final plat, after recording, and all supporting documents transmitted with the final plat to the Village Board, shall remain on file in the office of the Village Clerk. A copy of the recorded final plat shall be delivered to the subdivider.
   B.   Final Plat Form And Content:
      1.   Final Plat Form: The final plat shall be drawn at a scale of one inch equals one hundred feet (1" = 100'). Variation in scale may be allowed when determined by the Village Engineer to be necessary for a clear depiction of the subdivision. When more than one sheet is used for any plat, each sheet shall be numbered consecutively, and each sheet shall contain a notation showing the total number of sheets, and its relation to the other sheets (e.g. sheet 1 of 3 sheets). Linear dimensions shall be accurately depicted.
      2.   Final Plat Content: The final plat shall show on the face thereof:
         a.   The name of the subdivision.
         b.   The location and position of the subdivision indicated in each of the following ways:
            (1)   By quarter-quarter section, section, township, range, meridian, County and State.
            (2)   By distances and bearings from true north.
            (3)   By a written legal description of the exterior boundaries of the land as surveyed and subdivided.
         c.   The top of the plat shall be oriented north, and the plat shall contain a north arrow.
         d.   A graphic scale.
         e.   The dates of preparation and all revisions.
         f.   The description and location of all survey monuments.
         g.   Survey data sufficient to reproduce any line or reestablish any monument in the subdivision.
         h.   All streets, alleys, blocks, parcels, and public grounds into which the land is subdivided and of all easements and rights of way.
         i.   The length of boundary lines of all streets, alleys, blocks, lots, parcels, public grounds, easements, and rights of way. Where a boundary line is an arc of a circle, the radius and the length of the arc shall be shown.
         j.   The width of all streets, alleys, easements, and rights of way.
         k.   The minimum front yard building setback lines of all lots and parcels and a notation of the distance between such lines and the street right-of-way line, which shall not be less than that required by the Zoning Title.
         l.   The area of each lot and parcel.
         m.   Consecutive letters on all blocks and consecutive numbers on all lots throughout the plat.
         n.   The name of each street and an appropriate label designating all other easements, rights of way, setback lines, dedications and reservations (e.g. "Dedicated for Park Purposes" or "Reserved for Public School Site").
         o.   The abutting street lines of all adjoining subdivisions, shown in their correct location by broken lines.
         p.   The water elevation of adjoining lakes or streams at the date of survey and the high watermarks of such lakes or streams: if any portion of the land with a subdivision shown on any final plat is subject to flood hazard by storm waters, such fact and portion of land so affected shall be clearly shown on the final plat by a prominent note on each sheet of the final plat whereon any such portion shall be shown.
         q.   Utility and Village easement dedications.
         r.   Consent of Lake County Health Department, Lake County Department of Transportation, and Illinois Department of Transportation, if required.
      3.   Other Information:
         a.   A duly executed subdivision agreement, in form approved by the Village, wherein the subdivider agrees to install at his expense all the improvements in accordance with the plans and specifications, and approved by the Village Board of Trustees and Village Engineer, within two (2) years of final plat approval.
         b.   A letter of credit issued in conformity with the approved Village form, or other comparable performance guarantee, in form approved by the Village, as may be approved by the Village Attorney, with an expiration date of not less than two (2) years after final plat approval. Said letter of credit or other comparable performance guarantee shall be provided in an amount as required by the Village Engineer, but in no case shall it be less than one hundred thirty percent (130%) of the Village Engineer's estimate of the costs of the improvements, as set forth in the approved plans and specifications, plus the cost of engineering inspections. The letter of credit or performance guarantee may be reduced commensurate with the completion of the work; provided, however, that the remaining balance shall equal or exceed one hundred thirty percent (130%) of the cost to complete the balance of the improvements, as determined by the Village Engineer, and further provided that in no event shall a letter of credit or other performance guarantee be reduced below twenty five percent (25%) of the original amount, until all required improvements are completed and accepted by the Village Board. No more than two (2) reductions in the letter of credit or performance guarantee shall be permitted to any subdivider before final release of the performance guarantee. Upon dedication and acceptance, a maintenance guarantee, in the approved Village form, shall be deposited with the Village in the amount of ten percent (10%) of the original performance guarantee. Such guarantee shall be in effect for two (2) years from the date of acceptance of the required improvements.
         c.   Sufficient information to confirm that all other conditions and requirements of preliminary approval have been satisfied.
         d.   Payment of all required Village fees.
   C.   Certificates: The following duly executed certificates shall appear on the plat as depicted in Section 11-5-1 of this Title:
      1.   Owner as to the ownership, drainage, and subdivision of the property.
      2.   Surveyor as to compliance with Municipal and State regulations, including the drainage and monument certificates.
      3.   Chairman of the Plan Commission.
      4.   Village Engineer.
      5.   County Clerk.
      6.   Village President and Village Clerk.
      7.   Owner and engineer drainage certificate.
      8.   Lake County Health Department.
      9.   Lake County Division of Transportation as to County highway access.
      10.   Illinois Department of Transportation as to State highway access. (Ord. 96-445, 6-2-1996)
