7-3-3: PROHIBITED ACTIVITIES; EXCEPTIONS:
   A.   Advertising, Posting Notices:
      1.   No person shall display any placard or advertisement of any kind in any park; nor shall any person distribute, cast, throw, or place any handbill, pamphlet, circular, advertisement, or notice of any kind; nor post, stencil, or otherwise affix any notice or bills, advertisements, or other papers upon any structure or thing in or about any park except as herein provided.
      2.   No person shall post or otherwise affix any bills, notices, or other paper upon any trees or shrubs within any park within the village.
   B.   Birds And Animals: No person shall trap, catch, wound, kill, or treat cruelly, or attempt to trap, catch, wound, or kill any bird or animal or molest or rob any nest of any bird or animal in any park.
   C.   Dogs And Cats: No person shall bring a dog or cat within a park unless on a leash.
   D.   Riding Animals: No person shall lead or allow to be loose upon park property any horse, pony, or other riding animal except in areas designated for riding and by written permission of an authorized village official. Any animal found within a park in violation of this section may be apprehended; removed to an animal shelter, public pound, or any other place provided for that purpose; and impounded, all at the expense of the owner.
   E.   Camping: No person shall place, erect, or use any hammock, swing, tent, or shelter or otherwise camp or sleep in a park except such organizations as have received written permission from an authorized village official.
   F.   Clothing: No person shall enter or remain in a park unless properly and decently clothed.
   G.   Disorderly Conduct: No person shall make, aid, countenance, or assist in making any loud, unusual, or improper noise, threat, fight, disturbance, nuisance, breach of the peace, or disturbance of the peace and quiet in a park, or be guilty of any disorderly conduct therein, or collect with other persons, in bodies or in crowds, for unlawful purposes, or for any purpose to the annoyance, obstruction, or disturbance of other persons or lawful assemblage.
   H.   Excavation: No person shall excavate or take soil, plants, flowers, shrubs, or other property of any kind from a park, except by written permission from an authorized village official.
   I.   Fires:
      1.   No person shall light or make use of any fire in a park except at such places as may be established for such purpose such as fireplaces, stoves, or fire pits provided for picnics. Personal grills are not permitted. Every fire shall be continuously under the care and direction of a competent person from the time it is kindled until it is completely extinguished.
      2.   It shall be unlawful to start a fire of any kind in a park without a permit for the same except for picnics and only for fires to be located in a fireplace, stove, or fire pit provided for that purpose.
   J.   Games And Sports:
      1.   No person shall engage in any sport, game, or amusement in a park except at such places and times as may be designated by the park and then only under such rules as are prescribed. Trampolines, inflatable bouncers/slides/moonwalks, "Slip 'N Slides", pools, etc., are not permitted. Further, no person shall walk, remain, or conduct himself upon such portion of a park designated for any particular game, sport, or amusement in such a way as to interfere with the use of such portion by persons who are using the same for the particular sport, game, or amusement for which it has been designated;
      2.   No person shall engage in any activity in a rough or reckless manner so as to endanger, injure, or damage persons or property in any way.
   K.   Proper Behavior: No person shall use any abusive, threatening, profane, indecent, or obscene language, or language calculated to occasion a breach of the peace; induce, commit, or perform any indecent or obscene act or behavior; or exhibit, possess or transfer indecent or obscene pictures, writings, or articles of any kind within a park.
   L.   Drugs: No person under the influence of narcotic drugs shall enter, be, or remain in a park, nor shall any person sell or transfer any narcotic drug in a park.
   M.   Intoxicating Liquor: Consumption of any alcoholic beverage shall not be permitted within any park or park facility except that the village board may approve the consumption of liquor at specific events sponsored by the village.
   N.   Parental Responsibility:
      1.   Parental Responsibility:
         a.   The parent or legal guardian shall be responsible for the care, supervision, actions and conduct of their unemancipated minor(s).
         b.   The parent or legal guardian of an unemancipated minor shall be presumed, in the absence of evidence to the contrary, to have failed to exercise proper parental responsibility, and such minor shall be deemed to have committed the acts described below with the knowledge and permission of the parent or guardian.
         c.   It shall be unlawful for a parent or legal guardian to allow an unemancipated minor to engage in acts in violation of this chapter. Each parent and legal guardian shall be jointly and severally liable.
         d.   The village shall hold parents and legal guardians of an unemancipated minor who reside with such parent or legal guardian liable for actual damages for the wilful and malicious acts of such minor which cause injury to a person on village property or injury to village property, as provided in the "Illinois parental responsibility act" 1 .
      2.   Parties: Every person who commits, attempts to commit, conspires to commit, or aids or abets in the commission of any act declared herein to be unlawful, as a principal, agent, or accessory, shall be guilty of such offense, and every person who falsely, fraudulently, forcibly or wilfully induces, causes, coerces, requires, permits or directs another to violate any provision of this chapter is likewise guilty of such offense.
      3.   Nonexclusivity Of Penalties: The penalties provided for in this chapter are in addition to and not exclusive of any other remedies available to the village as provided by applicable law. The penalties provided for in any section of this chapter may be imposed or assessed in addition to and not necessarily in lieu of the penalties provided for in other sections of this chapter.
   O.   Picnics:
      1.   It shall be unlawful for persons to assemble in or upon a park or the village hall building except according to the rules established by the village board. No person shall scatter, throw, or deposit any paper, food, or waste material upon the grounds of the park or in the village hall.
      2.   Picnics requiring fires may only be held in those areas where fireplaces, stoves, or firepits have been provided for that purpose. Personal grills are not permitted.
      3.   Individuals or organizations dispensing food, soft drinks, dairy products and confections, or any products may do so only in the area designated by an authorized village official. In the event the dispensing of the aforementioned products is by sale, they may only be sold to the members of the organization attending the function and not to the general public except by written permission from an authorized village official.    P.   Day Camps And Similar Groups: No person or organization shall bring or cause to be brought into a park any play class, day camp, or other organized group of any kind organized for profit except with the written permission of the village board. Not for profit agency day camps, play classes, or organized groups may use facilities of the park with the written permission of the village board. Insurance and an indemnification agreement may be required. When issuing a permit, the village may require permit conditions including, but not limited to, designated areas of park facility for use by permittee as well as permitted dates and times for use. The permit fee to use the park facility shall be set by the village board for the given application; the fee shall reflect the cost to administer the permit. The permit fee for not for profit organizations shall be half of what the fee would have been for a for profit organization. (Ord. 2016-988, 6-7-2016)
   Q.   Protection Of Property: No person shall mark, injure, damage, destroy, or take in any way park plants or property of any kind, or any property of others in a park or otherwise interfere with the use of a park by the public. No person shall bring any plant or portion of a plant onto a park. No person shall remove, pour, or otherwise discharge any injurious or vile substance of any kind upon waters, grounds, or property in a park. No person shall climb upon any plants, fence, structure, or property of any kind in a park, except such recreational equipment as may be installed by the village for such purpose. No person shall bang, hammer or drill any stake or any other object into the park's grounds without written permission of an authorized village official.
   R.   Refuse And Garbage: No person shall deposit or leave any garbage, refuse, or other material of any kind within a park. Paper, glass, cans, garbage, and other refuse of any kind resulting from picnics or other proper use of a park shall be deposited only in receptacles provided for that purpose, and no person shall litter, suffer, or cause a park to be littered in any way.
   S.   Skating And Sledding And Swimming And Snowmobiling: No person shall swim, skate, sled, snowboard, ice skate, toboggan, ski, slide, or carry on any other similar activity in a park except at such places and times as may be designated for the respective activity. No person, while engaged in such an activity, shall conduct himself in such a manner as to annoy others or to endanger, injure, or damage persons or property in any way. Sleds are not permitted to go down the south, east and west sides of the sled hill adjacent to village hall. The creation of "moguls" on or near the sled hill is not permitted. The use of snowboards, toboggans or snowmobiles on the sled hill is not permitted. Swimming, ice skating and ice fishing is not permitted in the pond adjacent to village hall. Use of a park's grounds by snowmobilers shall require the approval of the village board; insurance and an indemnification agreement may be required.
   T.   Weapons And Missiles:
      1.   No person shall bring, carry, or use in any way, knives, firearms, or other weapons of any kind, or any fireworks or other explosive substances of any kind in a park. No person shall throw, cast, or shoot stones, arrows, or other missiles of any kind within a park, except at such places and times as may be designated for such purposes. No person shall carry or transport a weapon or missile in any vehicle in the park.
      2.   This subsection T shall not apply to police officers or members of the armed services while performing official business in the park.
   U.   Baseball And Softball Playing:
      1.   No person shall engage in games of softball and baseball except in those parks which have established diamonds and backstops constructed for that purpose.
      2.   In those parks having established diamonds, participation in softball or baseball in areas other than the established diamonds is limited in accordance with signs or notices posted.
      3.   In those parks having established softball or baseball diamonds, the type of participation on said diamonds may be regulated in accordance with posted signs or notices.
   V.   Removal Of Sand, Gravel, And Similar Materials Prohibited: The removal or taking away of any sand, gravel, clay, earth, soil, stone, or other material of any kind or nature whatsoever, from a park by any person, either as principal or agent, for any purpose whatsoever other than for village purposes, on order of the board of trustees, is forbidden.
