7-3-2: DEFINITIONS:
For the purposes of this chapter, the following definitions shall apply:
AUTHORIZED VILLAGE OFFICIAL: The village president or the village administrative assistant or the village administrator or the chairman of the parks and village hall committee or the designee of the chairman of the parks and village hall committee.
COMMERCIAL SOLICITATION: Any one or more of the following activities, not done for charitable, political or religious purposes, by a person on village park property:
   A.   The sale of, or seeking to obtain orders for, the purchase of goods, wares, merchandise, foodstuff or services of any kind, character or description, for any kind of consideration whatever.
   B.   The sale of, or seeking to obtain prospective customers for, any application or purchase of insurance of any type, kind or character.
   C.   The sale of, or seeking to obtain subscriptions to books, magazines, periodicals, newspapers or any type or kind of publication.
DESIGNATED PUBLIC FORUM: An area on village park property designated by the village for expressive purposes or activity.
PARADE: Any march or other organized movement of persons from place to place, or about a place.
PARK: Wadsworth Community Park, Orchard Park, Campanella Field, the Wadsworth Village Hall and its adjacent grounds and/or all public property owned, operated, or maintained by the village of Wadsworth, excluding street rights of way, and including, but not limited to, those properties owned, operated, or maintained by the village of Wadsworth which are located within Evergreen Subdivision or adjacent to Jody Lane or Caroline Avenue.
PERMIT: The written authorization issued by or under the authority of the village to a person or persons to do or engage in a particular act or acts on village park property, subject to the terms and conditions specified in the permit.
PERSON: Any individual, association, partnership, corporation, or any other legal entity.
POLITICAL SOLICITATION: Means and shall include the handing out of campaign related materials, soliciting for contributions or votes, soliciting for signatures on candidate and referenda petitions and recruitment to political campaigns or organizations, and campaigning for votes or support.
RELIGIOUS SOLICITATION OR CHARITABLE SOLICITATION: The request by a person on village park property directly or indirectly, of money, credit, property, financial assistance or other thing of value on the plea or representation that such money, credit, property, financial assistance or other thing of value will be used for a religious or charitable purpose. These words shall also mean and include the following methods of securing money, credit, property, financial assistance or other thing of value on the plea or representation that it will be used for a religious or charitable purpose as herein defined:
   A.   Any oral or written request.
   B.   The distribution, circulation, mailing, posting or publishing of any handbill, written advertisement or publication.
   C.   The public making of any announcement concerning an appeal, assemblage, athletic or sports event, bazaar, benefit, campaign, contest, dance, drive, entertainment, exhibition, exposition, party, performance, picnic, sale or social gathering to be held within a village park which the public is requested to patronize or to which the public requested to make a contribution for any religious or charitable purpose connected therewith.
   D.   The sale of, offer or attempt to sell, any advertisement, advertising space, book, card, chance, coupon, device, magazine, membership, merchandise, subscription, ticket or other thing in connection with which any appeal is made for any religious or charitable purpose, or where the name of any religious or charitable person is used or referred to in any such appeal as an inducement or reason for making any such sale, or when or where in connection with any such sale, any statement is made that the whole or any part of the proceeds from any such sale will go or be donated to any religious or charitable purpose.
TRADITIONAL PUBLIC FORUM: An area of a village park generally used or likely to be used by the public for purposes of assembly, debate and communicating thoughts between citizens and discussing public questions. Specific examples include sidewalks, streets and open park areas.
VEHICLE: Any device or instrumentality used or designed for the transportation of people, animals, plants or inanimate objects, whether motor powered or not, including, without limitation, any tractor in tow of any size, kind or description, except baby carriages, bicycles when properly used on walks, and vehicles in the service of the village.
