4-2-2: SCAVENGER LICENSE REQUIRED:
   A.   All scavengers who collect solid waste, recyclables and yard waste from all persons in the village of Wadsworth shall obtain an annual scavenger license from the village.
   B.   Scavenger licenses will be valid from January 1 through December 31 and the fee for same will be two hundred fifty dollars ($250.00) annually.
   C.   Scavenger licenses will automatically terminate on the day of commencement of any solid waste, yard waste and recyclables collection franchise the village enters into in the future.
   D.   All scavengers shall deliver all collected recyclable materials to the waste management intermediate processing facility ("facility") in Grayslake, Illinois, or to such other SWALCO designated facility as directed by the village. The village may terminate the license if the scavenger fails to abide by the rules and regulations set forth by the facility used for the processing of collected recyclable materials.
   E.   Scavengers shall prepare and submit to the village and to SWALCO reports detailing recyclables collection activities for the previous month, including, without limitation, recycling participation rate, the amount of recyclables collected and the vendor purchasing or receiving the recyclables. Reports shall be submitted quarterly no later than thirty (30) days following the end of the quarter.
   F.   The services to be rendered by the scavengers herein shall be performed in an orderly, efficient and workmanlike manner with a work force adequate to accomplish the same on a regular basis despite adverse conditions, equipment breakdowns or similar hindrances, all to the reasonable satisfaction of the village. Scavengers shall not litter premises in the process of making collections, nor allow any solid waste, yard waste or recyclables to blow or fall or spill from any vehicle used for collections. Scavengers shall replace lids or covers on all containers immediately after emptying.
   G.   All proceeds from the sale of recyclable materials shall be retained by the scavengers. Scavengers agree to provide a quarterly accounting statement, pertaining to the village, detailing the volume of recyclable materials collected and verifying compliance with all provisions of this section. Notwithstanding the foregoing, scavengers acknowledge that SWALCO has in effect a rebate program whereby SWALCO receives certain funds from the facility and distributes a portion of these funds to its members, including the village, and that all scavengers must waive any claim to any portion of the funds collected by SWALCO through this program.
   H.   Scavengers will distribute all solid waste containers (minimum of 95 gallons) and recyclables containers (minimum of 65 gallons) to their customers in the village.
   I.   Scavengers at their expense shall be required to develop, print and distribute to all village customers a brochure approved by the village explaining its recycling programs. The brochure shall be updated and distributed not less than annually. Whenever there is a change in the service or programs provided, or as directed by the village, scavengers shall also print and distribute an updated brochure.
   J.   Scavengers shall be responsible for billing all customers directly and for collection of all accounts due.
   K.   Scavengers shall provide the village a certificate of insurance that specifically names the village of Wadsworth as an additional insured. The village will also require a copy of the policy endorsement certifying that the village is named additional insured. The certificate of insurance shall contain at a minimum a one million dollar ($1,000,000.00) general liability policy, a one million dollar ($1,000,000.00) auto/vehicle liability policy, a one million dollar ($1,000,000.00) workers' compensation policy and an umbrella coverage policy of five million dollars ($5,000,000.00).
   L.   Scavengers shall indemnify, defend and hold harmless the village, its officials, employees, agents, representatives and attorneys, in both their official and individual capacities, from and against any and all injuries, deaths, claims, losses, damages, suits, demands, actions and causes of actions, expenses, fees, including attorney fees, and costs which may accrue against the village in consequence of the issuance of a scavenger license or which may result from or arise out of any action or omission of the scavenger, its officers, employees, agents or subcontractors, including, without limitation, any action or omission related to the disposal of any solid waste, yard waste or recyclables.    M.   Scavengers shall collect solid waste, recyclables and yard waste from their customers only between the hours of six o'clock (6:00) A.M. and seven o'clock (7:00) P.M. Monday through Saturday. Scavengers shall not collect solid waste, recyclables or yard waste from any of their customers on Sundays or on the following holidays: New Year's Day, Memorial Day, Fourth Of July, Labor Day, Thanksgiving Day or Christmas Day.
