4-1-4: UNNECESSARY NOISE 1 :
It shall be unlawful for any person to make, continue or cause to be made any loud, unnecessary or unusual noise or any noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the limits of the Village. The following acts, among others, are declared to be loud, disturbing and unnecessary noises which constitute a violation of this section, but said enumerations shall not be deemed to be a comprehensive list of all prohibited noises:
   A.   Horns, Signaling Devices: The sounding of any horn or signaling device on any automobile, motorcycle or other vehicle on any street or public place, except as a danger warning; or the sounding of any such device for an unnecessary or unreasonable period of time.
   B.   Radios, Phonographs: The using, operating or permitting to be played, used or operated any radio, television, stereo, musical instrument, compact disc player or other machine or appliance in such a manner to disturb the peace, quiet and comfort of neighboring persons or at any time at such a volume which is louder than necessary for convenient hearing.
   C.   Loudspeakers And Amplifiers For Advertising: The using, operating or permitting to be used, played or operated any television, radio, musical instrument, photograph, loudspeaker, sound amplifier or other machine or device for the producing or reproducing of sound which is broadcast upon the public streets for the purpose of commercial advertising or attracting the attention of the public to any building or structure.
   D.   Animals And Birds: The keeping of any animal or bird which, by causing frequent or long continued noise, shall disturb the comfort or repose of persons within the vicinity.
   E.   Exhausts: The discharge into the open air of the exhaust of any steam engine, stationary internal combustion machine, motorboat or motor vehicle except through a muffler or other device which effectively prevents loud or explosive noises therefrom.
   F.   Construction Or Repairs: The erection, including excavating, demolition, alteration or repair of any building, structure, road, bridge or any other construction activity, including, but not limited to, the operation of pile drivers, steam shovels, pneumatic hammers, derricks, steam or electric hoists or heavy construction equipment, other than between the hours of seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M. on weekdays, and eight o'clock (8:00) A.M. and five o'clock (5:00) P.M. on Saturdays, except in the event of a bona fide emergency or in the interest of public health and safety. If the building inspector should determine that construction activities at other times are necessary due to a bona fide emergency, or in the interest of public health and safety and that no unreasonable inconvenience will result to others, the building inspector may grant a permit for a specific duration for specific hours for such construction activities, upon application being made prior to or during the progress of any such construction activity. Homeowner performed repairs or improvements are permitted on Sundays from eight o'clock (8:00) A.M. to five o'clock (5:00) P.M. (Ord. 92-371, 8-18-1992)
