§ 130.06 ANIMALS AND FOWL; KEEPING, TRANSPORTING, TREATMENT, AND HOUSING.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ANIMALS. Includes farm animals and all other animals, reptiles, and feathered birds or fowl except dogs, cats, gerbils, pigeons, hamsters, and caged household birds, up to six female chickens, which must be confined and kept no closer than 50 feet from a neighboring residence, up to one colony of honeybees, and up to two rabbits.
      FARM ANIMALS. Cattle, horses, mules, sheep, goats, ponies, ducks, geese, turkeys, chicken, guinea hens, honey bees, and rabbits.
      TAKING. Pursuing, shooting, killing, capturing, trapping, snaring, angling, spearing, or netting wild animals, or placing, setting, drawing, or using a net, trap, or other device to take animals. TAKING includes attempting to take wild animals, and assisting another person in taking wild animals.
      WILD ANIMALS. All living creatures, not human, wild by nature, endowed with sensation and power of voluntary motion, and includes mammals, birds, amphibians, reptiles, crustaceans, and mollusks.
   (B)   Keeping. It is unlawful for any person to keep or harbor any animal, not in transit, except:
      (1)   Farm animals kept in that portion of the city zoned to permit agricultural purposes;
      (2)   Animals kept as part of an exhibition sponsored by a local organization;
      (3)   Animals used in a parade;
      (4)   Animals kept in a laboratory for scientific or experimental purposes;
      (5)   Animals kept in an animal hospital or clinic for treatment by a licensed veterinarian; or
      (6)   Animals kept in a city-owned zoo.
   (C)   Animals in transit. It is unlawful for any person to transport animals unless they are:
      (1)   Confined within a vehicle, cage, or other means of conveyance;
      (2)   Farm animals being transported in a portion of the city zoned for agricultural purposes; or
      (3)   Restrained by means of bridles, halters, ropes, or other means of individual restraint.
   (D)   Treatment. It is unlawful for any person to treat an animal in a cruel or inhumane manner.
   (E)   Housing. It is unlawful for any person to keep any animal in any structure infested by rodents, vermin, flies, or insects.
   (F)   Trespasses. It is unlawful for any person to herd, drive or ride any animal over and upon any grass, turf, boulevard, city park, cemetery, garden, or lot without specific permission therefor from the owner.
   (G)   Taking of wild animals in the city limits. It is unlawful for any person to take wild animals within the city limits and other city property, except these restrictions:
      (1)   Does not apply to taking of fish during open season;
      (2)   Permits to take wild animals will be granted with a permit from the Chief of Police and local conservation officer annually; or
      (3)   Permits in permit areas will be assigned by a random drawing.
