(A) The city will transfer existing mining permits to new operators upon request under the following circumstances:
(1) The new operator provides in writing that he or she will follow all plans and conditions of the previously approved permit; and/or
(2) The new operator provides financial sureties to replace those of the past operator. The existing financial assurance shall remain in effect until the new operator’s financial assurance is approved.

(B) Corrective actions, fines and/or temporary or permanent revocation of mining permit may be implemented by the city if the mining operation is non-compliant with the terms of the permit.
