For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BUSINESS. Any corporation, partnership, sole proprietorship, firm, enterprise, franchise, association, organization, self-employed individual, holding company, joint-stock company, receivership, trust, union or other legal entity.
BUSINESS WITH WHICH HE IS ASSOCIATED. Any business in which the person or a member of the person's immediate family is a director, officer, owner, employee or owns or controls more than 10% of the profits, assets or stock of a business (excluding control of assets in a nonprofit entity or labor union).
CANDIDATE FOR PUBLIC OFFICE. Any person who has filed a declaration of candidacy or a petition to appear on the ballot for election as a Township official, and any person who has been nominated by a Township official or Township body for appointment to serve as a Township official.
CODE OF ETHICS. The New Jersey Local Government Ethics Law, N.J.S.A. 40A:9-221 et seq.
FINANCIAL INTEREST. Any interest which shall yield, directly or indirectly, a monetary or other material benefit (other than the duly authorized salary or compensation for his services to the Township) to the Township official or Township employee or to any person employing or retaining the services of the Township official or Township employee,
GIFT. A payment, subscription, advance, forbearance, rendering or deposit of money, services or anything of value. GIFT shall not include a political contribution otherwise reported as required by law.
IMMEDIATE FAMILY. A spouse, parent or dependent child or any other relation residing in the same household.
INCOME. Any money or thing of value received or to be received as a claim on future services, whether in the form of a fee, salary, expense, allowance, forbearance, forgiveness, interest, dividend, royalty, rent, capital gain or any other form of recompense or any combination thereof.
INTEREST. The ownership or control of more than 10% of the profits, assets or stock of a business organization, but shall not include the control of assets in a nonprofit entity or labor union.
OFFICIAL ACTION. An action that a person performs in a given state of facts in a prescribed manner in obedience to the mandate of legal authority, without regard to or the exercise of the person's own judgment upon the propriety of the action being taken.
PERSON. A business, individual, corporation, union, association, firm, partnership, committee, club or other organization or group of persons.
POLITICAL CONTRIBUTION. Any advance, conveyance, deposit, distribution, transfer of funds, loan, payment, pledge, purchase of a ticket to a testimonial or similar fund-raising affair or subscription of money or anything of value, except volunteer services, in connection with a political campaign, and any contract, agreement, promise or other obligation, whether or not legally enforceable, to make a POLITICAL CONTRIBUTION.
POLITICAL ORGANIZATION. Any two or more persons acting jointly, or any corporation, partnership or any other incorporated or unincorporated association which is organized to, or does, aid or promote the nomination, election or defeat of any candidate or candidates for federal, state, county, municipal or school board office. POLITICAL ORGANIZATION includes, but is not limited to, organizations otherwise defined as "political committee," "joint candidates committee," and "legislative leadership committee."
SOLICIT. To seek by oral or written communication a contribution as the same defined in § 150.10 of the Township Code.
TOWNSHIP BODY. Any agency, board, body, including the Township Committee, bureau, division, office, commission or other instrumentality within the township, including any entity created by more than one county or municipality, but shall not include a school board.
TOWNSHIP EMPLOYEE. Any person, whether compensated or not, whether part-time or full-time, employed by or serving on a township body who is not a township official, but shall not mean any employee of a school.
TOWNSHIP OFFICIAL. Any person, whether compensated or not, whether part-time or full-time, elected to any office of a township body, serving on a township body which has the authority to enact ordinances, approve development applications or grant zoning variances, who is a member of an independent municipal, county or regional authority or who is a managerial executive or confidential employee of a township body, as defined in § 3 of the New Jersey Employer-Employee Relations Act, (N.J.S.A. 34:13A-3), but shall not mean any employee of a school district or member of a school board.
