10-3-2: PROHIBITED ACTS:
   A.   Driving Animals Through Streets: It shall be unlawful for any horse, cattle or other domestic animal to be driven loose through the city without sufficient attendants to keep said animal from trespassing upon lawns or adjoining lots; and the owner or any person having in charge any such animals who shall drive the same along and through the streets or alleys of the city and shall, on so doing, permit or suffer any such animals to go upon such lawns or lots, shall, for each and every offense, upon conviction, be fined not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00).    B.   Cruelty To Animals:
      1.   It shall be unlawful for any person to permit any draft animal of the species of horse or mule to remain hitched or tied on any of the public streets or alleys or on any private property for an unreasonable length of time without providing such animal with proper food and water.       2.   Whoever shall be guilty of cruelty to animals in any of the ways hereinafter mentioned shall be fined as provided in section 1-4-1 of this code for each offense: (1925 Code § 28-36; amd. 1981 Code; 2009 Code)
         a.   By overloading, overdriving, overworking, cruelly beating, torturing, tormenting, mutilating, or cruelly killing any animal or causing or knowingly allowing the same to be done;
         b.   By unnecessarily failing to provide any animal in his charge or custody, as owner or otherwise, with proper food, drink and shelter; (1925 Code § 28-36; amd. 1981 Code)
         c.   By abandoning any animal; or (1925 Code § 28-36; amd. 1981 Code; 2009 Code)
         d.   By carrying or driving, or causing to be carried or driven or kept, any animal in an unnecessarily cruel manner. (1925 Code § 28-36; amd. 1981 Code)
   C.   Noisy Animals: No person shall keep or harbor any dog, whelp, bitch, cow, calf, horse, ass, or other animal shut up or tied up in any yard, house or other place in the city which, by barking, howling, braying, bawling or other noises, shall disturb the peace and quiet of any family, citizen or neighborhood. Every person violating the provisions of this subsection shall, upon conviction, forfeit and pay a fine as provided in section 1-4-1 of this code for every offense. (Ord., 10-2-1989; amd. 2009 Code)
   D.   Animal Fights: Any person who shall, within the city, keep or use or be in any way connected with the management of any place kept or used for the fighting or baiting of any dog, cock or other animal, or who shall permit such place to be kept or used on premises owned, rented or controlled by him, or who shall frequent or be found therein for the purpose of witnessing such fighting or baiting shall, in each case, upon conviction, be fined not less than twenty five dollars ($25.00) nor more than seven hundred fifty dollars ($750.00).
