9-5-3: REMOVAL:
Any owner, occupant, or lessee of real property shall have forty eight (48) hours after notice is delivered to any adult person residing at the property or posted at the property that the growth in violation of this chapter exists on said real property to correct the condition of said property which is in violation of this chapter. The certification under oath of the city official delivering or posting said notice shall constitute prima facie evidence that the notice requirements contained in this chapter have been complied with. Thereafter, the city may, without further notice, provide for removal and disposal of said excess growth and shall collect from the owner, occupant, and/or lessee the reasonable cost thereof. For these purposes, a charge by the city of two hundred dollars ($200.00) per hour for labor and equipment, plus disposal costs, if any, shall be deemed reasonable. (Ord. 13-08, 10-14-2013)
