9-4-1: DEFINITIONS:
ENFORCEMENT OFFICER: The zoning enforcement officer as provided in this code 1 .
VACANT BUILDING:
   A.   A building or portion thereof which lacks the habitual presence of human beings who have a legal right to be on the premises. In determining whether or not a building is "vacant", the following factors shall be determined to be conclusive evidence by the enforcement officer that the building is vacant:
      1.   A building at which substantially all lawful residential or business activity has ceased and is not actively for sale as part of a contractual agreement to sell the building.
      2.   The building lacks utility services, i.e., water, sewer, electric or natural gas, for a period of more than three (3) months.
      3.   The real estate taxes for the property have been unpaid for a period of two (2) years or more.
      4.   There is the presence or recurrence of uncorrected code violations.
   B.   The term does not include unoccupied buildings which are undergoing construction, renovation, or rehabilitation, and which are in compliance with all applicable ordinances, codes, legislation, and regulations, and for which construction, renovation or rehabilitation is proceeding diligently to completion.
