5-3-4: BURNING TRASH 1 :
   A.   Definition: Trash materials include paper, wood or any other material that is capable of being burned and is no longer intended by the owner thereof to be used by him in the further conduct of his business. (Ord., 11-3-1958; amd. 1981 Code)
   B.   Hours: No burning of trash materials or leaves shall be allowed after four o'clock (4:00) P.M. within the city limits. (1981 Code; amd. 2009 Code)
   C.   Incinerators:
      1.   Location: No incinerator for the burning of trash materials shall be located within ten feet (10') of any building or other property.
      2.   Inspection And Approval: No incinerator shall be put in use until it is first inspected and approved by the fire chief. Thereafter, it will be at all times subject to inspections as deemed necessary by the fire chief. The operation of such incinerators shall be under the direction, supervision and control of the fire chief. (Ord., 11-3-1958; amd. 1981 Code)
   D.   Business District: Trash materials shall not be burned at any time in the business district within one block in all directions of the public square except in an incinerator constructed of bricks, concrete, steel, wire or other fireproof material and must be so built to prevent fires or sparks from spreading in any direction in a manner that will endanger any building or adjoining property of any kind.    E.   Penalty: Any violation of this section will subject the offender to a fine of not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00) for each offense. (Ord., 11-3-1958)
