§ 93.99 PENALTY.
   (A)   Whoever violates the provisions of this chapter shall be fined not more than $100. Each day of continued violation shall constitute a separate offense.

   (B)   (1)   Except as provided in division (B)(2) of this section, any person convicted of violating any provision under §§ 93.20 through 93.28 shall be subject to a fine in an amount up to $25 for the first occurrence, $50 for the second occurrence and $100 for the third occurrence.
      (2)   Any person convicted of violating the provisions of § 93.28 by not having a valid permit shall be punished by a fine in an amount of $1,000 per occurrence with each day of non-compliance being deemed a separate office.
      (3)   An action to abate such nuisance or otherwise seek compliance with §§ 93.20 through 93.28 may be brought as provided under Indiana law. All legal costs, including attorneys’ fees shall be added to any judgment award obtained by the city.
