§ 154.17  FINAL PLAT; FILING; APPROVAL; FEE.
   (A)   General. The final plat shall conform substantially to the preliminary plat as approved and, if desired by the subdivider, it may constitute only that portion of the approved preliminary plat which he or she proposes to record and develop at the time.  However, the portion conforms to all requirements of these regulations.
      (1)   Final plat shall be drawn in ink on tracing cloth on sheets not to exceed 18 inches by 24 inches and shall be at a scale no smaller than 100 feet to the inch.  Where necessary, the plat may be on several sheets accompanied by an index sheet showing the entire subdivision. For large subdivisions the final plat may be submitted for approval progressively in contiguous sections satisfactory to the Plan Commission. The final plat shall show the following:
         (a)   Primary control points, approved by the City Engineer, or descriptions and “ties” to the control points, to which all dimensions, angles, bearing, and similar data on the plat shall be referred;
         (b)   Tract boundary lines, right-of-way lines of streets, easements, and other rights-of-way, and property lines of residential lots and other sites, with accurate dimensions, bearings or deflection angles, and radii, arches, and central angles of all curves;
         (c)   Name and right-of-way width of each street or other rights-of-way;
         (d)   Location, dimensions, and purpose of any easement;
         (e)   Number to identify each lot or site and block;
         (f)   Accurate outlines and legal descriptions of any areas to be dedicated or reserved for public use with the purposes indicated thereon and of any area to be reserved by deed or covenant for the common use of all property owners;
         (g)   Locations and description of all survey monuments;
         (h)   Certification by a registered state land surveyor certifying to accuracy of the survey and plat;
         (i)   Protective and/or restrictive covenants, whereby the subdivider proposes to regulate land use in the subdivision and otherwise protect the proposed development in form for recording;
         (j)   Certifications showing that all taxes and special assessments due on the property to be subdivided have been paid in full;
         (k)   Proper form for the approval of the City Council, with space for signature as follows:

         (l)   Approval by signature of city, county and state officials concerned with the specifications of utility installations;

            2.   This approval of the final plat shall not be deemed to constitute or effect an acceptance by the public of the dedication of any street or other proposed public way or space shown on the plat;
         (n)   A notarized statement by owner dedicating streets, rights-of-way and any sites for public use;
         (o)   Name of subdivision;
         (p)   Location by section, township and range;
         (q)   Title, scale, north arrow and date;
         (r)   Ground elevations on the tract, based on mean sea level datum. For land that slopes less than .50%, show not less than 1-foot contours; for land that slopes .50% to 2%, show not less than 2-foot contours; and for land that slopes more than 2%, show not less than 5-foot contours;
         (s)   Other data. The other certificates, affidavits, endorsements, or dedications as may be required by the Plan Commission in the enforcement of these regulations;
         (t)   Cross sections and profiles of streets showing grades approved by the City Engineer. The profiles shall be drawn to scales approved by the Engineer and elevations shall be based on mean sea level datum;
         (u)   A subsidiary drainage plat showing; ditches, swales, storm sewers, culverts and indicating designed discharge capacity.
   (B)   Procedure for approval of final plat.
      (1)   Application for approval of the final plat shall be submitted in writing to the City Clerk and shall be accompanied by the fee as required in these regulations. The application shall be submitted at least 20 days prior to the meeting at which it is to be considered. The Clerk shall submit the application and plat to the Plan Commission for its review and recommendations and approval or disapproval.
      (2)   Ten copies of the final plat required for approval shall be prepared as specified and shall be submitted to the Clerk within 1 year after approval of the preliminary plat; otherwise the approval shall become null and void unless application for an extension of time is made to and granted by the City Council. The extension will not require an additional fee or filing of additional copies of the plat.
      (3)   Within 30 days after application for approval of the final plat, the Plan Commission shall approve or disapprove it. If the Commission approves, it shall affix upon the plat the certifying signature of its Chairperson. If it disapproves, it shall set forth its reasons in its own records and provide the applicant with a copy.
      (4)   Filing.
         (a)   After approval of the final plat by the Plan Commission and the fulfillment of the requirements of these regulations, the final plat of the subdivision shall be submitted to the City Council for approval.
         (b)   Action must be taken by the City Council within 30 days after the final plat and all drawings, maps and other documents required have been submitted for its approval. The applicant and the City Council may mutually agree to extend the 30-day period.
         (c)   Upon approval by the City Council, the subdivider shall record the plat with the County Recorder within 3 months. If not recorded within this time, the approval shall be null and void. Immediately after recording, the original tracing shall be returned to the city.
   (C)   Fee for the approval of final plats.  One dollar for each lot within the subdivision plat submitted, with a minimum fee of $5.
