§ 99.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   A person, corporation, partnership, association or other entity who violates § 99.02 of this chapter shall be fined pursuant to this section. Each day that a violation occurs is a separate violation.
   (C)   A person who smokes in an area where smoking is prohibited under § 99.02 of this chapter shall be fined in an amount that is not less than $100 and not more than $250. A person who owns, operates, or otherwise controls a public place or place of employment that violates § 99.02 of this chapter shall be fined:
      (1)   Not less than $250 for the first violation;
      (2)   Not less than $750 for the second violation within 1 year after the first violation; and
      (3)   Not less than $750 for each additional violation within 1 year after the first violation.
