§ 97.39  REMOVAL OF DEAD OR DISEASED TREES ON PRIVATE PROPERTY.
   The city shall have the right to cause the removal of any dead or diseased trees on private property with the city limits when the trees constitute a hazard to life or property or harbor insects or disease which constitute a potential threat to other trees within the city. The Board or Forester shall notify the owners of the trees in writing. Removal shall be done by the owners at their own expense within 60 days after the date of notification. In the event of failure to comply with the provisions by the owners, the city shall have the authority to remove the trees and charge the cost of the removal as a lien on the property with the office of the Douglas County Recorder.
