§ 37.093  SUSPENSION WITHOUT PAY.
   (A)   Suspension without pay is another method of disciplinary action, to be used only for serious infractions or where the employee has not rectified deficiencies noted in verbal or written warnings. However, neither a verbal warning nor a written warning is a condition precedent for a suspension. The authority to suspend for 24 hours is vested in the department head with immediate notification to the committee chairperson (or Mayor or other Council member). Suspension by a department head is limited to incidents of employee insubordination or malicious bodily contact. The authority to suspend for 24 hours may also be exercised by the Mayor or committee chairperson, with immediate notification to the Council.
   (B)   Suspension without pay are limited to 10 working days for any infraction. The authority to suspend for 10 days must be with Council approval, subject to hearing rights set forth in § 37.097.
