§ 37.060  PAID VACATIONS.
   Only full-time and permanent part-time employees are entitled to paid vacations. The length of an employee's paid vacation is based upon years of continuous service completed as of their anniversary date each year. Vacation hours are accrued by pay period and available for use on an ongoing basis, with the exception of division (A) below. The following rules will govern paid vacations.
   (A)   New hires.  New employees are not entitled to use any vacation leave until 1 year of service is completed. An employee will accrue 1.54 hours paid vacation per pay period during the first year of service.
   (B)   Employees with more than 1 year of service.
      (1)   An employee with 1 full year of service but less than 5 full years of service as of his or her anniversary date will accrue 3.08 hours paid vacation per pay period.
      (2)   An employee with 5 full years of service but less than 9 full years of service as of his or her anniversary date will accrue 4.62 hours paid vacation per pay period.
      (3)   An employee with 9 full years of service but less than 10 full years of service as of his or her anniversary date will accrue 6.16 hours of paid vacation per pay period.
      (4)   An employee with 10 full years of service but less than 11 full years as of his or her anniversary date will accrue 6.46 hours of paid vacation per pay period.
      (5)   An employee with 11 full years of service but less than 12 full years as of his or her anniversary date will accrue 6.77 hours of paid vacation per pay period.
      (6)   An employee with 12 full years of service but less than 13 full years of service as of his or her anniversary date will accrue 7.08 hours of paid vacation per pay period.
      (7)   An employee with 13 full years of service but less than 14 full years of service as of his or her anniversary date will accrue 7.38 hours of paid vacation per pay period.
      (8)   An employee with 14 full years of service as of his or her anniversary date will accrue 7.69 hours of paid vacation per pay period.
   (C)   Limitations on vacation length.  No employee may take more than 10 consecutive working days of vacation (exclusive of holidays) without the prior consent of the appropriate committee.
   (D)   Limitations on vacation accrual.  No employee shall accrue more than 2 year's total accumulated hours, as follows:

12 to less than 13 years service

   (E)   Accumulation of prorated vacation hours.  A non-probationary employee who is receiving disability leave pay directly from the city will be entitled to earn prorated vacation leave at the same rate of compensation as he or she is being paid (for example, if he or she draws 33% salary, he or she will be entitled to earn 33% of the vacation leave normally entitled to).
   (F)   Payment of vacation credits upon termination.  An employee whose employment is terminated will receive payment at the then current straight time rate of pay for all vacation time accrued and unused. If an employee dies, the employee's estate will be entitled to such payment.
   (G)   Requests for vacations.
      (1)   Full-time police officers will, in writing notify the Chief of Police no less than 30 days prior of a request for use of vacation leave. Full-time police officers will not be granted vacation leave during Douglas County jury trials.
      (2)   All other employees will request vacation time in writing according to the following:

      (3)   Employees shall use the form designated by the City Council for this purpose, and shall submit the notice to their respective department head for approval or denial. Department heads shall give notice to their respective committee chair, to any other committee member if the chair is not available, or to the Mayor if the committee chair and members are not available.
   (H)   Minimum increments of vacation.  Employees will take paid vacations in 0.25 hour increments.
   (I)   Paid vacation for permanent part-time employees.  The earning rate for permanent part-time employees is based on the average number of hours worked (for example, an employee working 75% time earns 75% of the vacation leave as a full-time employee with the same length of service). Part-time employees working less than 50% time are not entitled to vacation leave.
   (J)   Unpaid vacations for part-time and temporary employees.  A part-time employee is entitled to vacation to the same extent as a full-time employee with equivalent lengths of service. However, a part-time employee will receive no pay during vacation. Temporary employees are entitled to no vacation but may take unpaid vacations at the discretion of their respective department heads.
   (K)   Vacation pay.  Vacation hours will be turned in on regular time sheets and will be paid on regular pay rates.
