AN ORDINANCE ENACTING A CODE OF ORDINANCES FOR THE CITY OF VILLA GROVE, ILLINOIS, REVISING, AMENDING, RESTATING, CODIFYING AND COMPILING CERTAIN EXISTING GENERAL ORDINANCES DEALING WITH SUBJECTS EMBRACED IN SUCH CODE OF ORDINANCES
   WHEREAS, the present general and permanent ordinances of the City of Villa Grove, Illinois, are inadequately arranged and classified and are insufficient in form and substance for the complete preservation of the public peace, health, safety and general welfare of the municipality and for the proper conduct of its affairs; and
   WHEREAS, the Acts of the Legislature of the State of Illinois empower and authorize the political subdivision to revise, amend, restate, codify and compile any existing ordinances and all new ordinances not heretofore adopted or published and to incorporate such ordinances into one ordinance in book form; and
   WHEREAS, the Mayor and City Council of the City of Villa Grove, Illinois, has authorized a general compilation, revision and codification of the ordinances of the Political Subdivision of a general and permanent nature and publication of such ordinance in book form; and
   WHEREAS, American Legal Publication Corporation has compiled, edited and published a codification of the permanent and general ordinances of the City of Villa Grove, Illinois, in book form; and
   WHEREAS, there is now on file in the office of the City Clerk, for public inspection a document entitled "Code of Ordinances of the City of Villa Grove, Illinois".
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF VILLA GROVE, DOUGLAS COUNTY, ILLINOIS, AS FOLLOWS:
   Section 1.   The general ordinances of the City of Villa Grove, Illinois, as revised, amended, restated, codified, and compiled in book form are hereby adopted as and shall constitute the "Code of Ordinances of the City of Villa Grove, Illinois", which may also be referred to as the "Villa Grove Municipal Code".
   Section 2.   Such Code of Ordinances as adopted in Section 1 shall consist of the following Titles:
See Exhibit "A" attached hereto and incorporated herein by reference.
   Section 3.   All prior ordinances pertaining to the subjects treated in such Code of Ordinances shall be deemed repealed from and after the effective date of this ordinance except as they are included and reordained in whole or in part in such Code; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, no shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code.
   Section 4.   Such Code shall be deemed published as of the day after its adoption and approval by the Mayor and City Council and the City Clerk is hereby authorized and ordered to file a copy of such Code of Ordinances in the Office of the Clerk on that date.
   Section 5.   Such Code shall be in full force and effect as provided in Section 6, and such Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded, and approved and that any public hearings and notices thereof as required by law have been given.
   Section 6.   Reference applies to all amendments. Whenever a reference is made to this code as the "Code of Ordinances of the City of Villa Grove, Illinois", or as the "Villa Grove Municipal Code", or to any portion thereof, or to any ordinance of the City of Villa Grove, Illinois, codified herein, the reference shall apply to all amendments, corrections and additions heretofore, now and hereafter made.
   Section 7.   Title, chapter and section headings.  Title, chapter and section headings contained herein shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section hereof.
   Section 8.   Reference to specific ordinances. The provisions of this code shall not in any manner affect matters of record which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise and which are included within the code, but such reference shall be construed to apply to the corresponding provisions contained within this Code.
   Section 9.   Ordinances passed prior to adoption of the code.  The last ordinances included in this code was Ordinance 092203A, passed September 22, 2003.
   The following ordinances, passed subsequent to Ordinance 092203A, but prior to adoption of this code, are hereby adopted and made a part of this code:
      101403A:   An Ordinance amending Section 150.17(B) of the Municipal Code of the City of Villa Grove regarding fees for building permits
      122203A:   An Ordinance levying taxes for all corporate purposes for the City of Villa Grove, Douglas County, Illinois, for the fiscal year beginning May 1, 2003 and ending April 30, 2004
      020904A:   Ordinance amending Section 53.01 of Title 5, Chapter 53 of the Municipal Code of the City of Villa Grove (regarding water and sewer rates)
      032204A:   An Ordinance amending Section 8.05 of the City of Villa Grove Personnel Code

   Section 10.   Effect of code on past actions and obligations.  The adoption of this code does not affect prosecutions for ordinance violations committed prior to the effective date of this code, does not waive any fee or penalty due and unpaid on the effective date of this code, and does not affect the validity of any bond or cash deposited posted, filed or deposited pursuant to the requirements of any ordinance.
   Section 11.   Severability of Provisions.  If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code.
   Section 12.   Effective Date. This ordinance shall be effective upon its passage, approval and publication in pamphlet form as provided by law.
