The criminal liabilities imposed by this article shall not be construed to include any violation resulting from accident or caused by an act of God, war, strike, riot or other catastrophe as to which negligence or willful misconduct on the part of such person was not the proximate cause. Industrial Discharge Permit Application To the Department of Public Works of the City of Vienna: I, (Name) the undersigned agent being the responsible Authorized Representative of (Company Name) operating on the property located ___ (Company Facility Address) hereby request a permit to make an industrial sewer connection to serve the above named Company and to discharge wastewater to the City's sewer system as an Industrial User. Furthermore, I understand and agree to cooperate and comply with the requirements of the Pretreatment Program administered by the Department of Public Works. In consideration for the granting of this permit I, the undersigned, agree to provide to the Board: (1) A plan of the property located as described accurately showing all sewers, sewer connections, and drains now existing; (2) Plans and specifications for any and all work to be performed under this permit; (3) A complete schedule of all process waters and industrial wastes produced or expected to be produced at the above described location, including a description of the character of each waste, daily volume and maximum rate(s) of discharge, representative effluent analysis/analyses; (4) The name, address, and phone number of the Authorized Representative(s) of the Company who will provide for and assure compliance with this permit. In consideration for the granting of this permit I, the undersigned, agree: (1) To furnish any additional information relating to the installation or use of the industrial sewer for which this permit is sought as may be requested by the Board. (2) To accept and abide by all provisions of Chapter Three, Article 925 of the Ordinances of the City of Vienna, and of all other pertinent ordinances or regulations that may be adopted in the future. (3) To operate and maintain any waste pretreatment facilities as may be required as a condition of the acceptance into the wastewater treatment system of the industrial wastes involved in an efficient manner at all times and at no expense to the City. (4) To cooperate at all times with the City and its representatives in their inspecting, sampling and study of the industrial wastes and any facilities provided for pretreatment. (5) To notify the City immediately in the event of any accident or other occurrence that occasions discharge to the wastewater treatment system of any wastewater or substances prohibited or not covered by this permit.
