925.01 PURPOSE AND POLICY.
   (a)    This article sets forth the uniform requirements for the discharge(s) of "domestic" and "non-domestic" wastewater into the City of Vienna's collection system that transports sewage to PUB's Publicly Owned Treatment Works (POTW), a municipal wastewater collection and treatment system owned and operated by the Parkersburg Utility Board for the City of Parkersburg for treatment by the PUB. This article enables the City, the City of Parkersburg, and the POTW to comply with all applicable Federal and State laws required by the Clean Water Act of 1977 (P.L. 95-217) and other Pretreatment Regulations (P.L. 92-500, P.L. 1004,33 U.S.C. 1251, et. seq.; WV Code, Chapters 20 and 22; 40 CFR 403; 40 CFR 503; WV Legislative Rules, Titles 46 and 47), as amended.
   (b)    Where similar terms or requirements exist in other ordinances previously enacted by the City, or where the terms and requirements of this article are in conflict with those contained in other ordinances, the terms and requirements of this article supersede and shall govern.
   (c)    The objectives of this article are:
      (1)    To prevent the introduction of pollutants into the POTW which will interfere with the operation of the system, contaminate or otherwise interfere with the POTW's ability to efficiently manage the resulting sludge;
      (2)    To prevent the introduction of pollutants into the POTW which will pass through the system, inadequately treated, into the "receiving waters" of the POTW or the atmosphere, or otherwise be incompatible with the system;
      (3)    To improve the opportunity to recycle and reclaim wastewaters and sludges from the system;
      (4)    To protect the City, its employees, and the general Public from undue exposure to nuisance, toxic or hazardous discharges into the POTW, to protect and maintain the water quality of local receiving streams, to comply with Federal, State, and local water quality standards;
      (5)    To provide for the equitable distribution of the cost of operating the municipal wastewater system among the Users of the system.
   (d)    This article provides for the regulation of all "Users" of the City's sewer system. The emphasis, however, is directed especially to those Users of the sewer system who discharge or may discharge, into the sewer system, wastewater possessing characteristics in flow or composition, or having a pollutant content different from that ordinarily found in the discharge of domestic wastewater. A User discharging wastewater determined as being non-domestic shall be classified as a non-domestic User governed by the conditions and terms of this article through the implementation and enforcement of general and specific Federal, State, and Local requirements for sewer system usage.
   (e)    This article shall apply to Users residing within the City of Vienna and also to those Users residing outside the City's jurisdiction who are, by contract, permit or agreement with the City, Users of the City's sewer system. Except as otherwise provided herein, the City's Director of Public Works shall administer, implement and enforce the provisions of this article.
   (f)    This article authorizes permitting, monitoring, compliance and enforcement activities, assumes that existing customers' capacity will not be preempted, and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein. Additionally, for a User classified as a Significant Industrial User (SIU), as defined subsequently in this article, this article requires User compliance with Section 925.12.
   (g)    This article shall be reviewed by the City Council no less often than every two (2) years for the purpose of determining the character and composition of the wastewater contribution of Users to the sewer system. Subsequent to the review, and following receipt of cost information from the Parkersburg Utility Board, the City shall recommend appropriate effective rates and charges to be implemented in order to accomplish the following:
      (1)   Maintain the proportionate distribution of operation and maintenance (O&M) costs among the Users of the system; and
      (2)   Generate sufficient revenue to pay the total O&M costs necessary to properly operate and maintain the system including the repair and/or replacement of any appurtenance(s) as shall be required.
   (h)    The City will notify each User, at least annually, in conjunction with a regular bill, of the rates and that portion of the rates which are attributable to charges to the City by the PUB for treatment of wastewater attributable to the City of Vienna.
