No person shall in any manner improve any portion of a street, alley, public way or easement within the City, except by filing with Council a petition in writing signed by persons owning the greater amount of frontage of property abutting upon both sides of the portion of the street, public way, alley or easement, which petition shall set forth the street, or portion thereof, to be improved, the width thereof and the type of materials desired to be used.
Upon the filing of the petition, Council shall proceed thereafter in the manner provided for in West Virginia Code Article 8-18. (1965 Code §18-13)
