(a) The Vienna Tree and Beautification Commission, or the City, shall have the right to cause the removal of any dead, dying, diseased or structurally unsound trees on public or private property within the City limits, when such trees constitute a hazard to the public, health, safety, and welfare. (b) This authority includes, but is not limited to, trees that otherwise are on private property but overhang or otherwise protrude into public rights of way, streets, roads, highways, sidewalks, paths, and/or public utility lines.
(c) Further, this authority extends to and includes trees that may protrude into or otherwise affect an adjacent right of way, including underground utility lines, cables, pipes, or wires, such that it affects the use of the right of way in such a fashion as to pose a danger to the public health, safety, and welfare - including, but not limited to, damaging or having the potential to damage sewage lines, pipes, gas lines, electricity lines, and the like.
(d) The Commission or the City will notify in writing the owners of such trees. Tree removal, trimming, cutting and/or pruning, may be done by the owner at his or her own expense within thirty (30) days after the date of service of written notice. In the event of failure of the owner to comply with such provisions, the City shall have the authority to remove such trees and charge the cost of removal to the owner including the filing of a lien in the amount of the cost of the tree removal.
