729.08 POLICE STATION BUILDING USE FEE.
   (a)    This section is enacted pursuant to the provisions and requirements of West Virginia Code Article 16-8 as amended, and other applicable provisions of the law.
   (b)    It is hereby found, determined and declared that it is essential for the welfare, safety, advantage and convenience of the inhabitants of the City to construct certain improvements consisting of a police station building and necessary appurtenant facilities to insure and provide continued adequate police service and protections, and the inhabitants of the City are declared to be the users of such improvements.
   (c)    As used in this section, inhabitants and users are hereby declared to be the occupants, whether tenants or owners of all residential premises (which term includes houses, trailers and apartments), manufacturing plants and all business premises, (which term includes all businesses involving the sale of tangible personal property or the rendering of a service with the object of economic benefit) within the City.
   (d)    For the payment of the principal, interest and reserve payments on the one hundred sixty thousand dollars ($160,000) Police Department Revenue Bonds, Series 1984, and other costs and expenses authorized and directed to be paid as more fully set forth in the section authorizing such bonds and ordering construction of a police station building and necessary appurtenant facilities, there is hereby imposed upon the users thereof an annual fee or charge of eleven dollars forty cents ($11.40) payable in monthly payments of ninety-five cents ($.95) each, commencing on October 1, 1984, and on the first day of each month thereafter so long as any of the aforesaid bonds remain unpaid.
   (e)    The payment of the debt service of the one hundred sixty thousand dollars ($160,000) Police Department Revenue Bonds, Series 1984, shall be secured by a lien on the fees or charges derived from such improvements. The revenues derived from the improvements in an amount sufficient to pay the amounts provided for in this section, are hereby irrevocably pledged to the payment thereof.
   (f)   The same exemptions, right to appeal, procedure for collection of the fees and charges, and penalties shall be the same as provided for in Sections 729.04, 729.05, 729.06 and 729.99. (9-28-84.)
