(a) No person, firm or corporation shall dump, deposit or place or cause to be dumped, deposited or placed any refuse, waste, trash, debris, grass or plant cuttings, soils, dirt, stones, aggregates, rock or other similar materials upon any lot, tract or parcel of land, or upon any street, sidewalk, storm sewer, storm gutter, storm water channel or alley within the City. (b) Whoever violates this section shall be fined $100.00 for the first offense, $250.00 for the second offense, and $500.00 for every offense thereafter; prior convictions may be used for purposes of enhancing the penalty under this section if the date of the issuance of the previous citation is one year or less from the date of the current violation. If the date of the citation for the prior conviction is more than one year old, it is not available to enhance a second or subsequent offense.
