The congregating, roosting or nesting of pigeons in a particular place is a danger to health and property, is unwholesome and offensive, is the cause of annoyance to the public and individual citizens of the City and constitutes a nuisance.
Upon the application of any person, or without such application, the Chief of Police is hereby authorized to take such steps as he deems advisable to destroy such pigeons and to eliminate such nuisance. The Chief of Police may, if he deems it advisable, issue a written permit to any person to destroy such pigeons and eliminate such nuisance. Such permit shall state the location where such pigeons are congregating, roosting or nesting; the time, manner and method of destroying the pigeons and eliminating the nuisance; and shall provide such other conditions as the Chief of Police deems necessary to insure the safety of persons, property and other animals.
The Chief of Police may require of any applicant a deposit sufficient to cover the cost, in the event the Chief of Police deems it advisable to have such destruction and elimination performed by members of his department or other officials or employees of the City.
The foregoing provisions shall not apply to domesticated or tame pigeons so long as such pigeons are confined in a pen or other structure which is clean, sanitary and free from odor.
