(a) No person shall engage in any sport, game or activity involving the use of a ball upon or within the boundaries of any public street, alley or way.
(b) No person shall place, or permit to remain, any object owned by him or under his control or in his possession, upon or within the boundaries of any public street, alley or way in such proximity to such public street, alley or way which, by virtue thereof, causes or encourages those activities to take place which are prohibited by the provisions of this section.
(c) As used herein:
(1) "Object" includes, but is not limited to, a post, support, basket, net, bases, ramp or other object or thing customarily used, or which may be used, in connection with basketball, tennis, soccer, football, baseball, softball, volleyball, skating, skateboards, bicycle jumping or other sport, game or activity of any kind.
(2) "Owner" means any person who has legal title to an object, or has it under his control or in his possession.
(d) The City shall have the right to remove and take into its possession any such object found in proximity to or upon or within the boundaries of any public street, alley or way, which object shall become abandoned property if not reclaimed as hereinafter provided.
(e) If the owner of the object and his address is known to the City, the City shall give written notice to such person within five days after taking possession. Such notice shall contain a description of the object; where located at the time taken into possession; inform the person of his right to reclaim the object within twenty days after the date of the notice and upon payment of all costs incurred by the City in taking the same into its possession plus any storage costs and the cost of all notices; set forth the name and address of the City official to contact to reclaim the object; and state that failure to reclaim within the twenty day period shall be deemed an abandonment of all right, title and interest in and to such object and consent to the sale or other disposal thereof by the City.
(f) If the owner, or his address, is not known to the City, then the City shall post a notice in five public places within the City, which notice shall contain the same information as in subsection (e) hereof, and in addition, shall specify the time and place of sale of the object, which shall not be less than thirty days from the date of posting.
(g) The City shall sell the object to the highest bidder, pay all costs and retain any excess for thirty days during which time the owner may claim the same; at the expiration of thirty days, any unclaimed amount shall be placed in the general fund of the City and used for general City purposes. If the highest bid is insufficient to pay all costs, the City shall collect the deficiency by civil action or by any other means available to the City.
(h) Any person who violates any provision of this section shall be guilty of a misdemeanor and shall be fined not more than one hundred dollars ($100.00). Each day such violation continues shall constitute a separate offense.
(i) The provisions of this section shall not apply to any street hereinafter designated by Council as a "Play Street" pursuant to an existing ordinance.
