1322.12 AMENDING PROCEDURES.
   (a)   Initiation of Amendments. Whenever public necessity, convenience, general welfare or good zoning practices require, Council may by ordinance, after receipt of recommendations thereon from the Planning Commission, and subject to procedures provided by law, amend, supplement, change or repeal the regulations, restrictions and boundaries or classification of property. Amendments to this Code may be initiated by recommendation of the Planning Commission, by resolution of Council, or by the filing of an application by at least one owner or lessee of property within the area proposed to be changed or affected by such amendment.
   (b)   Application Requirements. All applications for amendments shall be filed with the Code Enforcement Officer. Application shall include the following as a minimum:
      (1)   Name, address and phone number of applicant.
      (2)   Proposed amendments of the Code shall have been reviewed by the Code Enforcement Officer prior to presentation to the Planning Commission.
      (3)   Describe use of the land.
      (4)   Present the zoning district.
      (5)   Describe the zoning district.
      (6)   A vicinity map at a scale approved by the Code Enforcement Officer showing property lines, thoroughfares, existing and proposed zoning and such other items as the Code Enforcement Officer may require.
      (7)   A list of all property owners and their mailing addresses who are within 61 meters (200 feet) of the parcels to be rezoned or who are a part of the rezoning.
      (8)   A statement of how the proposed amendment relates to the Code of the City of Vienna.
      (9)   A schematic plan or written evidence satisfactory to the Planning Commission indicating that the site is capable of being developed for uses within the proposed district with regard to traffic, soil, drainage, utilities, and topography and dimensional requirements.
   Applications proposed to amend, supplement, change or repeal portions of the text of this Code shall include only items (1), (2), and (8) listed above. (Passed 5-22-97.)
