Any person, firm, corporation or organization notified of non-compliance with this article or required to perform monitoring, analyses, reporting and/or corrective activities who is aggrieved by the decision of the Executive Director may appeal such decision in writing within twenty (20) days of the date of receipt of the order to the Board by the filing of a written appeal with the Chair of the Board. The appeal notice shall set for hearing the particular Order requirements or issues being appealed. The Board shall hear the appeal at its earliest practical date and may either affirm, revoke or modify the Order. Final orders issued by the Board may be appealed to the Vienna City Council by the filing of a written appeal with the Mayor of the City of Vienna within ten (10) days of receipt of the final Order of the Board. The appeal notice shall set for hearing the particular Order requirements or issues being appealed. The City Council shall hear the appeal at its earliest practical date and may either affirm, revoke, or modify the Order. The decision of the Council shall be final, but may be subject to review by a Court of competent jurisdiction.
